If you get any problems theres hundreds of helpful members to point you in the right direction...
The main thing is not to panic as all the letter templates & resouces you need is all on this site....& read read read...Make sure EVERYTHING you send to the bank goes by RECORDED MAIL...

What a great bunch you are!! Just telephoned the Data Protection Department in Cheshire to find out where my statements are and have been assured that they should be with me by the end of the week!! We'll see. What fun!! It's a nice feeling to be one in control for a while!!
Hi Michelle is there any chance you could let me have the telephone number for the data protection department. I sent a DPA letter for my brother 2 and a half weeks ago and we havent even had the usual letter, we have heard nothing and we have proof of delivery so i would like to chase it up.

Can I just ask why are you calling them???? Your letter is sufficent enough...It clearly points out your request....
By phoning them your possibly opening yourself up to questions which you may not be able to answer putting you in a very vunerable position as ALL conversations ARE recorded....
The letter templates on this site are Execllent & ask every question which shows the bank CLEARLY your intentions.....
you WILL get a reply (all standard replies mind) just by letting the letters do their magic....
Thanks Michelle will give them a call, a little push never hurt. I did exactly the same with Halifax, they were pretending they had no records but after my phone call they said i would have them in the next couple of days, 2 days later they arrived. Hope it happens again.
I agree with what you have said enoughs enough, the letters are good and do the job but they havent even acnowledged my letter and its coming up to 3 weeks. A phone call just to push them wont hurt before sending off the next letter. I certainly wont be answering any questions its their turn to answer to me.

Its totally up to you if you phone them & You have the confidence to answer any question asked....
I would just be aware that the Barclays have opened a specific department especially for charges claims & I bet they know a few questions to ask us to get us on the backfoot....
Heres my run of events.....
My statements arrived on the 40th day of sending my Data Protection Act....
Sent off my Prelim.........Had a standard reply within 7 days
Sent off my lba............Had a standard 50% offer reply within 10 days
Sent off my Rejection letter.......Going through money claim tomorrow 8th Sept
All this done without picking up the phone once...Honestly the letters are enough...There are over 1800 people who would also agree....

We're all in the same position but with the help of others on this board....& not just with claiming bank charges back....The big companies cant hide behind & fob us off with they're un-lawful T&C etc ANYMORE....
This site is probably the best Consumer help site in the UK ....

I know it isn't the 8% daily rate as you don't claim for that until the court stage. Can someone tell me how on earth I get this figure? Is this the 0.00022 x (charges applied)?? Also, we are advised to send a copy of the calculation of charges with letter, which one should I send? Again, I have lookd at the templates provided, one gives the 8% (simple excel) the other one freaks me out!!!!(advanced excel)?

the second excel is with interest for your overdraft as well ie if the charges make you go over your overdraft this spreadsheet works it out. most people dont use this as its very complicated.
1.When you go overdrawn the bank will charge you interest, perfectly lawfully.
However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.
Vampiress has a spreadsheet, (the advanced/freak me out one), in the bank templates library, which attempts to calculate this
It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother
This is the interest referred to in the preliminary and lba letters.
2. Section 69 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before moneyclaim
