    Default Urgent Advice Needed - Does the Sale of Goods Act Cover this?

    Regarding the toilet which has damaged my laminate flooring, woodwork etc, I would argue that a toilet that is under 2 years old should not be leaking. It is unreasonable to find a leak on a toilet of this age. I wanted to include the sale of goods act in my complaint, but because this was part of the house when purchased, would you still use this act? Is there a better act to quote, any legal stuff I should include?
    Im just composing a letter now, and need to finish it off!

    Regardless of the above, the leak is likely to be due to a problem from the plumbing rather then the toilet itself, so the toilet itself would not be faulty. SOGAicon wouldn't apply.

    Apologies to people who I was in the process of helping, I may be gone some time.

    Hiya bookworm, I decided that why should I fork out on the excess etc, when the house is still under Barratts 2 year new build guarentee - and it was the toilet leaking causing the majority of the damamge!

    Wonder what I could quote at them, im searching the site in desperation, but Ive got to go to work now dammit!

    Ill have to continue when I get home!

    If they offer a 2 year guarantee then just ask them - point out that the workmanship isn't up to scratch and has caused damage. As Bookworm said its most likely the plumbing thats at fault which is Barratts or whoever they contracteds fault.

    I'm a tenant and if this happened to me I'd be taking it up with my landlord; it's his property after all!

    I used to be a dummy, stuffed full of straw and standing in the field of life. And like the straw-filled dummy I was I accepted my lot in life and carried on, tied to a stake in the miserable field of depression as the elements beat me day and night. But there came a time when the elements had gone too far and the string holding me to the stake fell rotten to the ground. The elements had tried to beat me, but instead had set me free!
