    • Sorry I didn’t think to come and update this.    So the outcome was that he went to court. Apparently the judge told the landlord off for not sending a letter before action but did nothing about it. He didn’t accept all the damages the landlord claimed, and told him off for accusing my friend of deliberately and maliciously damaging anything, and he awarded him small amounts of the damages he claimed for. The landlord had also made an awful lot of things up that never existed and accused my friend of stealing them, and the judge didn’t accept any of those claims.   However, I’m back asking advice now. So he made an offer of payment via the court forms, sometime before Christmas and straight after the hearing. The landlord didn’t reply so the court accepted the payments.  My friend has been paying the £10 a month each month. Then a couple of days ago he had received a letter from court with a hearing date in a couple of weeks, and a very irate letter from the landlord saying that my friend has consistently lied and that nothing he says should be believed, and that he wants the bailiffs to be called on him and that he absolutely refuses the payment plan. The letter is marked as received by the courts in December and this is the first that’s been sent since then. My friend and his wife are now panicked, what does this mean? And can they now get bailiffs sent round? He earns an ok wage, which somehow the landlord has referred to in his letter, but he equally has a lot of expenditure and can’t afford to pay any more. What will happen at this hearing and can they send out the bailiffs just because the landlord wants them to?    I have no clue what to advise him, can you help at all please?
    • Thanks Bank – I took your cynicism / experience on board and responded thus: Thank you for your response Mr Schnur  I set out my position quite clearly in my letter of claim and nothing has changed. Your insurance requirement is unlawful and is contrary to section 57 of the Consumer Rights Act, and also section 72 of the same statute. I would also refer you to the outcomes in PENCHEV v P2G (225MC852) and SMIRNOVS v P2G (27MC729).  My deadline for action - 1 May 2024 - still stands.
    • The other thing is that you are making a big mistake imagining that they are at all concerned about wasting court costs et cetera. They are only concerned about being obstructive and discouraging others.  
    • I have dad's last will from 2019 which mentions the trust. I am in the process of going through probate as the only thing that needs probate is a couple of shares he has (under £3000).  Speaking to my brother and my dad's wife they wouldn't mind going with another solicitor if we need to pay extra for the trust.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just issued a claim via Moneyclaim.com against the Halifax Plc for £854.40 and now I'm starting my quest to have £577.55 of illegal charges reimbursed from the RBS.

 

I have prepared my Preliminary Letter and will be sending it off first thing tomorrow morning (recorded delivery) to the RBoS Senior Customer Relations Manager, FREEPOST, P.O.Box 1727, Edinburgh, EH12 9JN.

 

I'll keep you informed.

any reason whay you are going straight to Edinboro and not via your Branch? I would suggest that you will get the standard Fig Off letters from them without consideration. Maybe going through your Branch, may be a little more long winded but you will be allocated a case number more quickly and may be offered an early goodwill gesture to bouy up your claim.

 

Worth a quick think I would suggest, also it gives you reason to begine MCOL proceedings against an English address (MCOL not relevant North of Border!!).

Steve,

 

if you can get a name at the Branch (probably the asst Manager) who is dealing with your requests, then you will get swifter responses, provided they reply in the first place of course. They will escalate your case to Head Office as required, but deal locally if you can. You may then be able to hand deliver your letters and get a delivery receipt and have the wonderful feeling of seeing the look on the Bank Staffs faces when they read your request. But please remember that the Staff are human also, so keep it real and don't take your frustrations out on them. Use the CAG for that!!! Ha HA! I found that the Staff can be sympathetic to your cause, they may not be able to do much about it as they now seem hamstrung by red tape, but if you are not claiming serious amounts, then they may broker a deal with you at their level.

 

Oh, I used the Branch fax machine as well to ensure delivery (my Branch is 100 miles away from my home) and a follow-up "have you got it?" phonecall.

I've just posted my Prelim via recorded delivery (didn't want to make any personal appearances at the branch as I get on quite well with the staff there - I'll leave those 'til later, depending on the response I get).

 

The only grief I have about the RBS are the charges they apply (obviously!). Other than that I quite like the RBS and the staff that work in my branch. I've been keeping my accounts pretty much up to date over the last 12 months and if I do occassionally fall by the wayside they tend to phone me up at work to let me know. As long as I submit some money to the account to cover the debit by 3pm that day, I'm not subjected to any charges.

 

Not every bank operates like that, so I'll be sorry to have the account closed if my claim is successful.

I received a reply from my local RBS branch manager today informing me that he has ordered duplicate statements for my account dating back to December 2000 in order to investigate the matter fully. He has promised to contact me again on or before Thursday 21st September, either with a full response, or to let me know what progress he has made.

 

My LBA should be arriving on his desk at the same time!

Re. My last post.

 

Not only did my local branch manager order duplicate statements (for his benefit, not mine!), I looked at my account on-line today to see that the 'so and so' has applied a £5.00 charge to my account for the privilege!!

 

I phoned up the branch to tell them I was very annoyed about this and would not pay it, and was told to write to him personally!

 

One very strongly worded letter coming up.....!

Following on from my last post, RBS reversed the charge that was applied to my account for the duplicate statements the very next day. I didn't need to write that letter.

 

Today, I received a letter from the local branch manager to say, in short, that they deemed the charges as fair and they will not be refunding any of the charges applied to my account.

 

My LBA will be on it's merry way to him tomorrow. That'll be a nice start to his week on Monday! :rolleyes:

sounds like the standard letter, you will be passed on to Tommy Mclean soon for another preprinted letter. I'd start getting your ducks in line for the MCOL if I were you. You can start the MCOL and save it ready to go back to and just press the GO! button as your deadline passes!!

Well, I have not had a letter from Tommy Mclean, or from anyone else for that matter, in response to my LBA. So, the next step is MCOL.

 

Question. I previously sent my Preliminary Letter and LBA to my local branch manager. Who should I address the MCOL to? My branch manager or id there a head office address?

Easiest way is to address it to the Branch, that way it stays in England and they can't try and delay any more than they normally do!!

I submitted the claim on 4th October before I read your response to my previous post. I addressed it to the Litigation Group at 1 Princes Street, London.

 

It was acknowledged by RBS on 10th October.
