Looking for some advice please?

 

Sent a prelim to RBOS asking for ppi that was mis-sold to my mum to be refunded Total amount £1800.

 

No reply so I sent the LBA.

 

Today my mum received a letter stating that she signed for it so it wasnt mis-sold. I think we have a string case that she was mis-sold as since looking at the t&cs she had to be employed at least 16 yrs a week and my mum has been medically retired since 1989 so wasnt even entitled to be covered by it in the first place.

 

What is my next step please? Should I write again stating this or go straight to court claim?

 

If court claim could someone please advise what i need to write and which form to use (Im in Scotland so cant use MCOL)

 

Any help would be great.

Hi, Im in Scotland too, Just had fight with TSB Insurance over mis sold PPI insurance...And WON today.

Halifax settled in Full.. :D 22/09/06

TSB First Claim SETTLED IN FULL 19/10/06 :D

Second Claim to Lloyds TSB - Settled in Full

Firstplus - early settlement interest charges - Challenged the use of the rule of 78 - SETTLED IN FULL 12/1/07

PPI - GE Money / Purpleloans / Firstplus - Now Settled after 1 year long hard fight.

I am currently trying to get a refund of PPI that my mum has paid on her RBS credit card. The amount she has paid is approx £1800, I sent the prelim and LBA to them and she just received this is part of the reply from them:

 

" This insurance is designed ro protect you in the event of sickness, unemployment or death, as long as you meet the requirements stated in the Terms and conitions of the Payment Protection Policy. YOU are advised to check if you qualify for the cover"

 

My mum is disabled and the terms and conditions state to qualify you must be working at least 16 hours per week. My mum hasnt worked since 1989 due to disability.

 

Surely it is their job to check someone qualifies?

 

What is my next step? I am really angry that they are saying it is up to the customer to check they qualify but they will be happy taking your money even if you dont.

 

Any advice what i should do next would be great. I dont know if this would be covered any under of the acts and dont know where to start???????????

When did she take out the insurance/agreement? I believe companies were forced since January 2005 to provide 'wants & needs' forms with PPI. Would be worth looking into. Can't guarantee info though as I've been skimming through site. I'm sure I've seen it somewhere though...

Just found original post by steveoram1 - post #7 on Payment Protection Insurance thread

 

PPI only came under the remit of the FSA in Jan 2005 and any policy sold before this date would have been unregulated. Things have changed dramatically since then. Now have to do a proper "Demands & Needs" document with customers and supply a Pre-Contract document to customers breaking down the sepatate charges for PPI etc before completing the finance docs.
