    Default maria v barclaycard, small victory quick response

    This is my first semi victory, so I am quite pleased, especially as this has been so fast.

    SARicon sent 22.08.06
    Statements recieved 31.08.06
    Prelim sent 31.08.06 requesting £432.00
    05/09/2006 £216.00 credited to my account.

    Only half has been refunded, are they allowed to keep the other half as OFT states they can charge £12.00?

    Allso I only found out by checking my account, I am waiting for letter from them, no doubt winging it's way to me now!!! Then I will continue to pursue the rest.

    Best suggestion is when they send the letter, respond by accepting the payment as part-settlement, and that you will be pursuing them for the balance through courts.

    There is no specified amount they are 'allowed to keep,' and the OFT did NOT state that they can charge £12. The OFT actually said that they would seriously consider legal action against any charges greater than £12, and that only a court could decide whether a charge of less than £12 was lawful...

    Well done though on getting half-way there in such a short space of time...
