Default 10 days and counting to Court

    Hi Guys,

My court date is on 15th September and so far haven't heard anything from Mr J, Barclaysicon or their solisitors.

Could I be the 1st (I think) to actually get my day in court, not that I'm worried as I've done all my research

Do people think I should expect a call soon?

    Cheers

    Hi,

I have just received a letter saying that Barclaysicon intend to defend my entire claim. Did you receive the same letter and do you think it is a delaying tactic?

So do I need to worry about actually attending court and have there been many cases that have gone to court?

Try not to worry (easier said than done somtimes), as said so many times before they do not want to go to court.

Bit of advice, try not to phone. You may end up slipping up or agreeing to something you didn't intend to. They record their phone conversations. Just tell them to put it in writing.

I found when I didn't return their call a letter arrived the next day with an offer. (Although my story is not yet concluded)

James Mclouglin (sp) made contact with me last week to discuss my case, anyway I didn’t have time to talk to him when he rang last Thursday but rang him back first thing on Friday morning. He advised me that whilst they didn’t contest the amount of the charges I was claiming and even hinted that they would be happy to settle. BUT it seems I may of made a bit of a boo boo, I have failed to indicate on some paperwork that I would be claiming the 8% interesticon (cant remember the paperwork he referred too). I said I needed the weekend to think about it and would ring him back on Monday. James then advised that he was changing departments and that Friday was his last day. He gave me Keith’s number and asked that I ring ASAP to get this case sorted.

Anyway, I rang Keith’s office today and surprise, surprise he failed to answer his phone, I left a message with one of his colleagues and asked that he rang me soonest. So far no call and the court date is on Thursday.

Can anyone offer any advice as to what I should do about claiming the 8%? I had made mention that I would be claiming it several times in correspondence leading up to this point.

    Cheers

If you added the 8% interesticon on the N1 form or MCOL, when you filed your claim, I dont really see how they can get out of paying it
