Council tax problem - the ex's half!!

So when My partner lived at his previous address with his ex, he was in the army and paid most the bills, the one she said she would pay was the CT. But she didnt, few years down the line, I ge ta baliff at my door.

 

He's looking for my partner, not a problem. So They agree to split the bill into 2, and my partner will pay his half by attachment of earnnings. This is working out fine and is almost totally paid off!

 

However 2 weeks ago, I get a letter addressed to the ex, come to my house! Im not happy about this, but due to the wonders of technology I found out her new address and work! So have passed this back to the council.

 

They informed me they would chase her for her half again, but once that exhausted it will come back to my partner.

 

However a week later a letter comes here saying that the CT has been to court and another liability order has gone on for the both of them!

 

Im guessing information has crossed paths, do I leave it and see what happens?? Just worried they will automatically take it from his wages, even though she has a job, no kids and earns more money then us!!

 

OMG! its so frustrating! Really unfair too!! Any ideas on how to continue?

The problem is that they were jointly and severally liable. That means that regardless they can chase one person or both together and in the case of the one person they can be made to pay the whole amount. As your now partner is paying his share they will just keep taking until it is all paid. In the case of the ex, if they refuse to acknowledge or respond there is little that can be done unless the Council apply for a Committal Hearing where both would be summonsed to appear - but as your partner is paying this is unlikely to happen.

 

As for another Liability Order, I'm afraid this sounds like another period of time where the CT was never paid. Your partner should ring the Council concerned and ask how many Liability Orders there are, how much each one is for, how much is outstanding on each and very importantly what periods of time they cover - it may be they have applied for a period when he had already moved! He should do this ASAP - apologies if I have the genders reversed.
