    Just to let you know that i sent my access request to the address that i gave you on 22nd August. I recieved all of my statements on 14 Sept. Prety good response. Proof that it works. Hope this info makes you feel better. Good Luck!

    Peter's optimism was justified, and the statements duly turned up a couple of weeks back. The total was pleasing: £479 including interesticon. My balance on the card is less than that!

    Prelim duly sent off on the 5th, which within a week generated a standard "We're sorry you're not satisfied" letter from the boys and girls in Southend-on-Sea. (Don't these credit card companies base themselves in some random places?!). They promised to get back to me within two weeks; not quick enough to prevent my lbaicon going off yesterday.

    They've now got until the 2nd of November before they get hit with a writ.

    I am about to start on Mint (one of my wife's cards). She has a default on this card with money outstanding, can she still claim the charges back?

    Sorry for the late reply, not been on for a while.

    Thanks for your kind wishes.

    As far as I understand it, the default does not prevent your wife from claiming. In fact, if the default was caused solely by unlawful charges, she would have a case for removal of the default through the courts. There are several threads on here which deal with that - search for "default".

    Ages since I gave an update, so here goes:

    18/11/06: received a letter from Mint informing me that they have refunded £424 in charges and £3.36 in interesticon to my account. They dispute my calculation of interest at £178.91. In fact I had claimed interest imposed by Mint of just £45.16, plus contractual interest of £133.75. They seem not to know what I mean by contractual interest.

    They say that because of the way charges are paid off before purchases and cash, the bank interest is just £3.36. I accept this - the spreadsheet I used assumed charges would be paid off LAST. A look at the back of my MINT statement shows that they do allocate payments in the way they say. Not all cards are like this, however.

    05/02/07: received a sod-off reply from Mint. They have paid the interesticon, so that's it. Not sure how far to pursue this one - has anyone else put a court claim in with just contractual interest left, after charges and bank interest have been refunded? Have you won?? I'm minded to back-burner this one until I've fried the bigger fish (Halifaxicon etc).
