    ***Update 15 Jan 06 - Allocation Hearing Date***


    Well my first post - i've done a lot of forum reading before i posted - and this site is great, some serious amounts of good advice and info her


    So i sent off to woolwich with the Data Protection Act letter, and received my scale of charges, added it all up...


    £3086.50!!!


    Nice.

    Just posting the claim letter today (1st Sep) I'll keep you updated how it goes from here, any tips gratefully received!

    Well the first tip is to read loads before taking action, but you've done that so you've started on a good footing. Now just follow each step as recommended, use the letter templates, stick to your timescales, not theirs and you'll be fine.

    Ok folks time for a bit of an update, so far i've sent the SARicon, claim letter, and now not long sent the lbaicon.

    So it's time for me to file for court action (since I've just had the typical "not interested" replies)

    My first letter was sent to Woolwich, after that I replied to the address on the letter i'd just received (which seemed to have varied between Woolwich and Barclaysicon addresses!)

    So I need to be sure that my court claim is filed against the correct address - can anyone confirm the right person/address to file against please?

    (had some good news the other day - MBNAicon have decided that they have done nothing wrong and are completely justified in the charges levied against me, but they've still sent me a cheque for £500 to add to the one for £300 they sent earlier - they've now paid me back everything I claimed for - so I don't really care what they say - and their money is now paying for the woolwich claim!)

    Ok bit of help needed here please folks

    Have just received my full settlement from MBNAicon which will pay for my court fees for taking Barclay/ Woolwich to court for the money they owe.

    I've already sent the lbaicon - and have just received and offer of £1000. I was just preparing the rejection letter as well as the spreadsheet to work out interesticon for the court claim. But there's a problem

    I've miscalculated the figure owing on my previous letters. I had worked it out as totalling £3086.50 (just bank charges, no interest) and have just worked out it's actually £3080. So what do I do? Obviously the full total will be greater for the court claim (when the interest is added) should i make the correction to the baseline figure as part of my rejection letter?

    Help. Please.

    This is a non-problem!! You can amend your figures up or down right up to moneyclaim, just put the correct figure in the rejection letter:

    Michael - thank you for putting my mind at rest - i was only out by £6.50 but wondered if that meant I had to start again with the request for payment and lbaicon or whether I could carry straight on with the rejection letter.

    I am thinking of sending them a copy of the Spreadsheet printout that I'll be using for the money claim to show the amount of extra interesticon I'll be claiming if it goes to court action (which I quite expect it to) in the hope this convinces them to offer the charges only fee to avoid the extra cost of interest.

    Ok just prepared my rejection of settlement letter, together with a copy of the schedule of charges worked out using the database.

    I've sent the schedule of charges that I'm going to file for the court claim as extra leverage to encourage a settlement - however I don't think there's a chance in hell of them doing it!
    Letter will be sent special delivery tomorrow - The time period from the lbaicon has already passed so i've included my phone number and said to that i'll be filing the court claim friday if they haven't been in touch with an offer of full settlement.

    Any top tip threads on how to fill out the online claim? I really don't want to slip up at this stage!

    The MCOL site has excellent guidance and FAQS. I did have to phone them to clarify something I wasn`t sure of (being a bit dense) and they were very helpful.

    just to update - the court claim is now filed - it states it as being served on the 14th, so I have to wait until the 28th to do anything.

    I'm *really* hoping that woolwich/Barclaysicon are far too busy to get round to responding to it...

    i'd much rather if they didn't bother with entering a defence - but that's just because my boss will kill me if i get a court date!

    (I won't have a problem getting time off to go to court - but he won't be pleased)
