    Default Common problem? If I 'make trouble' will they demand full repayment?

    I'm sure this is back in the Forum somewhere but I haven't found it so far......

    I would dearly love to take on my credit card companies as I have £££'s to reclaim. Problem is this. I also have loads still owing on the cards, which will not be paid off by the amount of money I might win.

    My nightmare scenario is that I start the process with (say) Eggicon. I currently have a large balance (£10k ish) outstanding on the card mainly comprising purchases. The moment I start the dispute they withdraw the card and demand full repayment of the entire outstanding balance. I can't do that so they issue a default notice...bankruptcy.....d isaster!

    This must be a very common circumstance. What advice/experience has anyone got?

    My advice - that this would be seen as retaliation - and not viewed well by the courts. You would have a strong case to sue them again if they did this.

    Hi,

    First of all to make you pay the debt off they would have to take you to court, IF you said to the court that you are willing to come to some payment plan then the chances are that the courts would go with this rather than make you bankrupt. No court wants to see you lose anything you have over a 10K credit card debt.

    If in doubt seek the advice of the Citizens Advice Bureau.
