Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Please can somebody help me!! I am going round the twist. Basically I booked my holiday through First Choice to the Dominican Republic for a 4* hotel with loads & loads of amenities! (yeah right)! On our arrival to the hotel it was awful an absoloute dive, with very few amenities we also found out that the hotel had been downgraded to a 3* hotel 6 months prior to our departure. First choice failed to tell us that! The holiday was a disaster, we ended up having to be moved after a week to another hotel. I complained to First Choice headoffice and after waiting for 28 days for a reply they have responded with an offer of £150 in vouchers I am absoloutly furious about this and wondered if anybody could offer me some more advice! Thanks in advance

Someone will know more but basically I would have thought that they breached their contract by selling you a 4* holiday and only supplying a 3* one. Which hotel was it and what was different from the brochure. Were there other people with the same complaints?
Thanx for your reply, yeah a few couples had to get moved hotel at the same time as me as they were disgusted with the conditions (it was superclub breezes puerta plata).
This was my first reply with them & I am seriously hacked off to be offered a measly £150 in vouchers; I would be happy with anything over a £1000 as the holiday cost well over 3 grand!!!!
Should I reply to them threatning legal action?? would it be worth going to court?? I felt that I should have a strong case as they downgraded the hotel without informing me.
No they are advertising it now as a 3*. I have the brouchure that I booked it through advertising it as a 4* and the brouchure that came out in April showing the new grading as a 3* ( I went on holiday in the July). Many of the facilities that were advertised for children were missing. Skating rink, playstation, cable tv, football, tennis, golf, water sports, swimming pool slides etc etc it was a disaster!!
The hotel they moved me into was a 4* but it lacked amenities for children, which was why I booked with superclub breezes. I had to stay for 8 days in that hell hole and there is no way I am going to accept £150 in vouchers, in my opinion it is a damn insult.

Did you complain to rep at time and what was her response - which hotel did you end up in?
Hi Gizmo, I replied to the rep in the resort on a daily basis, until my husband requested that she either gets us a flight home or moves us hotel. We were moved to the Gran ventana (however the rep told us not to inform any other holiday makers about this, or they will all want to be moved!!)

I would write back to First Choice and refuse their offer of vouchers, tell them you will take the matter to court if need be as you beleive them to be in breach of their contract.
They sold you a 4* holiday but only provided you with 3*, like most people you probably only paid the extra cos you thought you were getting a 4* holiday.
It cant do any harm to write another letter, their 1st offer of vouchers will simply be just that, their 1st offer, they do this cos some people will just except and go away, dont be one of those people, get writing hun, and dont let them away with it.
Good luck, let me know how you get on.
Brecken x
I'm going to sit over the weekend and draft a refusal letter to them & if that fails I shall get in touch with abta. Shall keep you all posted on my progress. Thanxs for the replies. xx
I say stick to your guns. You would definately have a case but like mine 'Hopeless holiday in Turkey' they will try to fob you off every step of the way.
Return your holiday vouchers along with your letter back to them, its such a worthless gesture that you wouldn't want to keep them! Their holiday to you has let you down but your £3000 won't have let them down in any way, shape or form!
They might try to steer you towards complaining to their governing body ABTA but your grievance isn't with them as they didn't sell you the holiday. I'd say you were entitled to a full refund due to breach of contract through misrepresentation.
Just to let you know the 14 days I've given my holiday company is up tomorrow and I've had no response. I wouldn't be surprised if they were calling my bluff to see if I will put them in court. I will and I'll let you know the outcome.
As for you, good luck and I hope you get somewhere.
Thanks Lady H. I have read your holiday hell & its absoloutly ridiculous that holiday companies think they can get away with this!! Good Luck & keep me posted how you get on x
Just thought I would update you all. I contacted first choice today by telephone to say that I would not be accepting there offer (£150 holiday voucher - yeah right!!!) They had stipulated in the letter that they had informed me of the downgrading of the hotel! I contacted my travel agent today whom I booked the holiday through - she also confirmed that head office did not inform me of the downgrading as everything is logged on her system. she has contacted head office to log this; so I will have to wait and see. I just sent another 3 page letter to them quoting a lot of stuff from abta! & told them they have until 21 days to respond with a satisfactory offer or I shall have no alternative but to seek full compensation through legal action. I shall keep you all updated. Thanks for all your kind reply's.
Hi
Just to let you all know that i recieved another letter from First Choice offering me £314 (final offer). Obviously I have refused this and I will go directly to court as this is an absoloute joke!! what an insult
Hi having read your threads - I sincerely hope that you get your money back or at least a high proportion of it. I am just embarking on a similar route with Solitair Holidays - a holiday company specialising in holidays for the single person. Having just returned from Cuba and advised I had booked a 4 star hotel x 2 the first one would indeed be hardly worthy of a two star. Me and my fellow travelling companions were fed raw fish - uncooked and uncooked chicken! risking food poisoning.
A coach with 8 seats on it to take us for an internal flight to Havana to celebrate new year did not arrive instead only a coach with 2 seats left arrived! leaving 6 of us stranded and being told nothing - eventually after complaining a taxi arrive taking another three people still leaving 3 behind - all concerned about making the flight - the worry and stress was immense.
During the stay trips we booked were an utter disapointment and were booked through Solitair travel associates - they also used a company called Holiday Places - this was the company that failed to deliver the coach! the story is endless and cost me over £2.5K including other expenses it totalled £3.5K this was supposed to be a relaxing and enjoyable xmas and new year break - yea I think NOT.
I am writing to the CEO of Solitair holidays today - however am not having much luck in obtaining his email from customer services. I would strong advise ANYONE NOT TO USE SOLITAIR HOLIDAYS - the tickets did not arrive and had to be emailed the day before the trip! they seem to have a total lack of organisation and yet charge premium prices! appalling service given.
