    Default Walton vs MBNA - unusual response!!!

    Ok guys I hope you can help

    I have sent of data protection act to MBNAicon for statements. They have repiled syaing charges are fair etc etc and supplied me with a Breakdownicon of charges but not statements. The charges come to £560 pounds and they have offered me £215 as a settlement. Plus they returned my cheque for Data Protection and said if I want full statements I must fill in the form they have supplied and return it with another £10 cheque.

    Now this link in the step by step says accept the money offered but only as partial settlement:

    MBNA have circumvented the step by step guide a bit here - maybe i should email them the link .

    In all seriousness, should I take/not take the money as partial payment and now approach them with a request for full payment as at the second link posted or jump straight to lbaicon. I have read the step by step and the FAQ but the response received from MBNA was a little unexpected when all I requested was data protection info statements.

    If they have not sent you statements, have they not failed to provide you with what you asked and therefore failed to comply with your Data Protection Act SARicon.

    "Please supply me with a complete list of transactions and charges relating to my banking history with your organisation"

    I wouldn't trust their Breakdownicon of charges one bit. Also you are not required to complete their form to get what you require. Delaying tactics.

    hi MBNAicon sent me statements and also didnt take the cheque. i phoned them and asked for the cash back they offered half, i said no they gave me the full amount. i have given the name and number of the guy i dealt with he seems to be getting all the cases. He was very nice and helpful it cant help to ask for it back i think you might get it. Gareth Tunnicliffe 01244 672628 Customer Advocate. :grin:

    MBNAicon sent me statments but only for the period they chose, so i dont know for certain what the histroy of my account was when prior to that period they decided to supply.

    That mean they havent complied with the SARicon.

    In addiotn to the charges you are entitled to ask for interesticon, either contractual or sec 69 if you so choose.

    I suspect the reason MBNA are being 'nice' is to dissuade you from digging any deeper into your account history and to try to reduce your payout by trying to avoid paying any interest.

    Well I did as advised and sent a letter saying they hadn't complied with SARicon and had 9 more days to do so. I also rejected their offer politely and stated that no settlement would be discussed until the SARicon information was supplied.
