Hi there,

 

I lived in a property back in 2002 (8 years ago) and yesterday I had a letter from the Council stating that I owe £676.93 from £2002. They gave me the dates to and from I lived there, which are incorrect and also it was a joiny tenancy.

After 6 years I thought that a debt was statute barred? does this apply to council tax.

Any advice would be greatly appreciated.

nope SB does not apply.

 

and it matter not if it was/was not joint.

they can hit you for all of it.

 

now, you need PROOF [utility bills etc etc or CT bill from new house etc etc]

 

to give to them to prove you were at the property XXX xxx

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I read somewhere that theres something about a limitation order?

 

If the Council obtained a Liability Order before 6 years was up then they can chase you for that until you draw your last breath.

 

As it was a joint tenancy then they can pursue either you or the other party and if necessary you would have to pay it all back yourself.

 

You need to ring the Council and ask when they obtained the Liability Order and how much it was for. I assumed you must have moved do any of the dates coincide with this, it may be that if you did not inform of your move you have been charged for the rest of that particular year.

Thank you for that, I will ask the Council tomorrow if they have a liabilty order and for how much it was for.

I did not inform the Council that I moved as I was evicted by a private landlord for that property.

 

That will probably explain the discrepancies in the dates. Do you still have any proof of moving at that time ie utility bills, new CT bills, DVLA etc maybe even old bank accounts.
