Hi, I have moved on quite quickly on my claim by following the advice on line and have done the actions below. I am now stumped and desperate for advice!!
1) Consulted branch manager for reimbursement of charges
2) Requested and paid for 6 years of statements
3) Compiled list of charges including interest
4) Sent 2 letters 14 days apart for full refund
5) Issued small claim paid court
After 28 days Nat West have defended the claim, I have been sent a questionnaire from the court. I have also received a soliciter statement from Natwest suggesting i have to defend in court.
Do i comunicate only with the court or do i need to respond to Nat West too??
you don't have to supply any information to Natwest, just copy them in with any correspondence you send to the court. Fill in the aq and send it back to the courts, if any more info is required by the judge the courts will request it.
Natwest sent me a CPR Part 18 request basically asking for info that they already know about. I think this is intended to scare you off with all of the legal spiel. You are not required to answer this as it's going through the small claims track. have a look at my thread Laffar v's Natwest to see how i responded to them.

I am now at the stage where a defence has been submitted by Nat West, so i am going to court for a judgement (unless they bottle it and pay up first!!). I need help with the form completion. What do I fill in section G - "Other Information"?
the rest of the form is simple facts, but how much detail is required here? Does anybody have a template i can use?

I too have a defence submitted by Nat West. Did they send you the aq form or did you obtain it from somewhere else?
Looks like we are both in the same boat! Part of me wants them to make and offer before it gets to court, but part of me wants to go to court to defend it and see the whole process through now I've started!

I have recently submitted my aq form into court and paid a further £100. Last week i received a letter from the soliciters saying they would be victorious in court, blah, blah.
I am claiming for £3000 in charges, and yesterday i received an offer from them for £1900. Is this as good as it gets or should i continue with my case to get the full amount?
If i do continue to court do i decline there offer in writing or just ignore it?
This is a standard tactic used by Natwest. i believe that the correct move is to accept it as a preliminary payment, but tell them you are continuing your action to claim the full amount. Anyone else got the text that does the job?
Edit : Ack I didn't see how old this thread was, sorry. It came up in 'Similar Threads' at the bottom when I was looking at the aq thread I linked. I assumed it was new.
Not won yet. I submitted my aq and was sent a letter from Natwest (Cobbetts) to say they will beat me in court etc etc.
I did not respond to this letter. Within a week they sent me another letter offering me half of what i was asking for!! Of course, I have declined this offer.
This was over a week ago and i have heard no more, but i have been informed that the court is reviewing the data and will be in touch soon?! All I can do now is wait........
It would appear I am also in the same boat as all you guys. Natwest acknowledged my claim and then on the very last day that they possibly could (28th day) they entered a defence.

I have turned down Natwests 50% of my claim offer and now have a court date... sadly its not until Early January but if thats how long I have to wait the then i can... as long as the moneys coming!
I have just returned from a well deserved weekend away, to find another letter from Cobbets.
I assumed it would be another moan or request for more data as I chased the court on Friday for a date, but low and behold, they have sent a cheque for the full claim!!!
Of course, with the usual request of silence and "although our client believes we would win in court...."

As soon as the cheque clears i will leave my donation and fill out the survey.
