Hi - A&L have sent me a letter which arrived the day before the letter before action deadline. It said, having noted your comments, I must advise you that our charges are clearly shown within our litrature........
I think this is a standard letter to call my bluff about going to court, am I right?
My claim is for £3759.04
Do I now just proceed to court without any further communication?

You have sent them the request for repayment giving the schedule of charges you wish to be refunded. You gave them a reasonable deadline. Your next step is to initiate court action.
Remember to include the 8% statutory interest and the paragraph about claiming the interest. Remember to include the 8% statutory interest in the calculation for amount you wish to claim, the paragraph only makes the 8% continue from the date of starting the court proceeding.
The instructions are on Money Claim online or in the leaflet if you use the paper approach. The On-line method is quicker but does not leave space for your schedule of charges. Don't be too worried about that, you have sent the bank that information already and probably be asked to do it again as part of the court process.
The likely outcome is that the bank will pay up before the hearing date but they may offer you a lesser sum in "Full and final settlement". Reject the offer. If you really need the money accept the payment as a part payment WITHOUT CONDITIONS. Be sure it is understood that it is a part payment and you expect full settlement and that the court action stands. Better to just reject it if you can, the situation cannot then be misunderstood.
Stick to your guns, you want all your money back unconditionally plus the 8% interest and the court fee.
Do not accept any conditions on payment. It may limit action you might wish to take in the future.

I am below the 1080 characters but it does go onto 25 lines, I have tried a few times to no avail.
Any advice would be great as I can't wait to submit my claim!!!!

Remove the schedule of charges which at £3974 must be quite large.
You can put a note on the claim to say that you have already sent the schedule to the defendant and that it will be made available to the court.
The Section 69 paragraph takes up a lot of space but it is necessary in its complete form.
Wow Lisa. Way to go girl. I almost wish my account was still open so that I could have the pleasure of closing it when I get my money back. I also have a small mind.
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

Expect your cheque in about 3 weeks Don't be shocked when you get the letter saying they intend to defend, the cheque arrives about 10 days after that!
well done you,,, I have today received a cheque from A & L for £838.66! Full and final settlement and they WILL be contacting me about my account to discuss its future operation!! But I dont care. I issued my MCOL on the 21st and the letter with the cheque was dated 1st September... so expect your cheque in about 10/11 days.... I also got the acknowledgment for MCOL saying they intended to contest the full amount... but I just ignored it!! Let me know when you have your money!! :o)
