    Default Can landlord keep my tools and sell them because Im in rent arrears?

    Im in arrears on my commercial workshop premises. The landlord has changed the locks and states that he is keeping all my tools and equipment and will sell them to recoup his money. Is this against scottish law and how can I get my equipment back. I have no money to pay the arrears and it is likely I will have to self declare banktrupcy. Thank you,

    Welcome to CAGicon,

    I think that would be classed as theft, as you've not given him permission
    to keep the tools, it might be an idea to report the matter to the local police station, if he wants to recoup the arrears, he should procede to
    court.

    I'm not expert in Scottish law.

    The post above is correct.

    Your Landlord would need a court order to claim your tools to be sold off for repayment.

    If your Landlord still has your tools without your permission, then he has stole them and you should report the matter to the police ASAP.

    For my tupence worth I’d have thought that the Sheriff would take a dim view of such action because these are the very tools you need to earn your living. How on earth can you landlord expect you to ever pay whilst he is depriving you access to the tools of your trade!

    The simplest of answers is:
    Yes. But only with an attachment order (if they were outside) and only with an exceptional attachment order (if they were inside).

    If you haven't received an attachment order served by a Sheriff Officer or Messenger at Arms - it is theft and illegal.

    You should call your local police station to report it as theft and get a crime reference number.

    A debt collector for my sins; I hope any advice I can offer of the industry can help. It might help me sleep at night.
