Help, i have got myself into a right muddle regarding the way i can claim for
charges relating to my Credit Cards.
I have been charged by Barclaycard on 4 occassions 20.00 each for Late Fees, making at total of 96.00.
If OFT suggest a fair charge is 12.00, does that mean that i can claim 4 x 12.00 = 48.00 and then 8% interest on the total of 96.00 = 7.68. Making a total claim of 55.68.
I am confused regarding the amount of the charges i can claim for, and the interest, and the more i look into it the more confused i get. ie if they are charging me 24.00 for late fee how much can i claim for ?

The £12 referred to by the OFT was an amount below which they (the OFT) would not take action. It is not an amount set by the OFT that the banks are allowed to charge. The banks are allowed to charge to recover the costs they incur in processing failed DDs etc. They are not allowed to profit from these charges.
So far they have not established a cost. Given that it all happens automatically the actual cost will be very low indeed so while they can make substantial profit from these unlawful charges (most still go unchallenged) they are unlikely to produce an actual cost and immediately be forced to reduce the charges for everyone.
Have not aclue about this site but want to claim to close on 3 years over charges from when I aws working abroad. What is the first move??

1 Read all the guidance and FAQs on this site
2 Read a number of the threads on the section relevant to your bank and/or credit card
3 start your own thread asking any questions you then have.

1. You can claim back 6 years. If you have all the statements for that period then what else are they going to send you? If there are gaps in your documentation then you have to decide whethet or not there would be charges to reclaim among the missing information. Provided there is at least one item on the requested information that you can reclaim, you should also claim for your £10 back.
2. Provided you send a schedule of your claim that clearly identifies, by date, desctiption and amount, all the items you are claiming back, there is no reason why you cannot go through the process again later for any that you missed. Be careful, of course, not to claim for the same item twice, that would be fraud.
Better to do it all in one go if you can but perfectly legal in sections.
The process is handled by the Sheriff Courts in Scotland.
Watch out for the value limit for the Small Claims procedure, it is £750 in Scotland. I Didn't see anything about statutory interest (the 8% in England & Wales). Best to ask the Sheriff Clerk's office.
