My bank manager has witnessed my personal guarantee. Is this independant?
I am in dispute with Lloyds TSB. It's a very long, painful story but I feel very badly let down by them and feel that a large part of their behaviour towards my company was deliberately reckless/unreliable.
The company is now closed and Lloyds are chasing for money. I have been looking at the personal guarantee I have signed with them and it does state that the witness signature has to come from an independent source.
It is witnessed by my bank manager - who incidentally, has misinformed me and let me down on numerous vital occasions.
Is this an independant witness and if not where does that leave me in regards to my personal guarantee and the money Lloyds are chasing?
Any advice would be incredibly gratefully received!
Re: My bank manager has witnessed my personal guarantee. Is this independant?
Was it a limited guarantee or unlimited? Was it with additional security? When was it signed? No I wouldn't consider a Bank Employee to be an independant witness. I'm sure someone can advise further
Re: My bank manager has witnessed my personal guarantee. Is this independant?
Hi and thanks for replying. The guarantee was limited and without security. It was signed in 08, around about the time my manager started becoming incommunicado at vital times and we found our overdraft limits seemed to fluctuate with the wind.
I hope this information is useful - I appreciate the comments as it helps me slowly build a picture of where I am and what I can do about all this.
