Hi Guys,

 

I recently submitted the above form to my old Council ( Moved Regions), however it shows we only can afford to pay £20 a month ( the debt stands at £800).

The debt was originally with a Bailiffs firm but now the council have recalled, but they say what we have offered it totally unacceptable and they are asking for £50 a month, even though it shows on the from we can only just afford £20 a month.

Where do I stand with this because I have offered a payment but they want more.

 

Please help guys.

A lot will depend on what you put on the forms. Do you claim any Benefits - from which it may be deductible - or is it just income - to which they could get an Attachment of Earnings. Council Tax is a priority debt and they will correctly argue you must pay it first before Credit Cards for example. Without knowing more it is hard to help.

 

If your sums are correct then you may need to get one of your old Councillors to argue for you.

Hi,

 

We don't have any credit cards, and we receive benefits(WFTC &CTC),which we listed on the form, just feeling a bit annoyed by it all because we have made a genuine offer on what we can afford.

Not too sure if they can get a deduction from those - I suspect not. You could always ask that they take it back to Court and ask the Court to set a level in which case £20 may even be too much. Am I right in assuming that because you have moved "Regions" you are in Scotland - if so may I suggest you send Idainfife a PM as she has a better understanding of Scots Law & Council Tax.

They can try but as the saying goes you cannot get blood from a stone. Councils are strap for money and they will not forgo their large salaries so they will try and make joe public pay does not matter if joe has to go hungry as a result.
