Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
From 1988 - 1996 we had a mortgage with the Bank of Ireland.
In the early 90s we got into trouble paying the mortgage due to the high interest rate at the time.
I had a particular nasty visit frim the Bank of Ireland officer who came to the house when I was on my own. I still bear the mental scars and stigma to this day he was horrible.
He pressured me in to returning our endowment policy over to him (with a letter to say that I had done so of my own free will.) This was to cover short fall in payments. Eventually we sold the house. We were also stung for an early redemption fee and a good few charges ie late payments etc.
My question is
Can I persue them for these charges over this period of time and if so, when I do my DPLetter does the 1998 act still apply to this or an earleir act. (How do I word the letter) ???
with mortgages you can go back 12 years instead of the 6 with banks and credit card charges.
There is ongoing work on a template letter, and if you look at a couple of other mortgage theads you will see the resulting letter taking shape.
