    Default Consumer Credit Act with DCA

    Hi There,
    I have recently applied to get a mortgageicon but was declined, I couldnt understand this as I have always been good with credit agreements. I then looked at my Experian credit report and it showed a default for Kings Hill, I queried this with Experian, who came back and said that it was in relation to a BarclayCard taken out about 4 years ago and Kings Hill have bought the debt from BC.

    I contacted Kings Hill to dispute the debt, and was told that BarclayCard would need proof of address, it turns out that whoever moved into my previous address has got hold of my details and taken out the card, used it for a while then run away. I have now sent over copies of driving licence and passport as proof of signatureicon, but have been told by DCAicon that it can take up to 8 weeks to obtain the original credit agreement. I have quoted CCA and the 30 day limit but DCA are saying that as they bought the debt from BC they are not bound by DCA and I just have to sit and wait. I have also been told by DCA that even if the signatures dont match I could still be liable as I have lived at the address where the agreement was taken out, all be it, not at the date on the agreement.

    How can I get this default removed and am I covered by any kind of consumer protection??

    I had the same issue with a First Direct Current Account, and they removed the record within a week and added a warning on CIFAS stating that I have been a victim of id thefticon.

    Please help I cannot get a mortgageicon with this default hanging over me...

    Get the account number and other details of the BC account from the DCAicon and write to Barclaysicon yourself, quoting the account details and enclosing a £1 cheque or postal order stating that you are making a statutory request under Section 78 of the CCA 1974.

    That should get you the agreement within 14 working days.
