    Smile Are these all 'penalty charges'?

    I am new to this and a bit confused. I want to claim back from Alliance and Leicester
    'Unauthorised overdrafticon charge' £25 per month, sometimes another £25 after day 2
    'Monthly OD charge - £5 per month
    'Failed DD charge' £34 a time

    Are all these penalty charges that I could claim back?

    yep first thing to do is send off for your statments (data protection letter) and then calcaluate what they've taken off oyu in the last 6 yearsicon then send the prelim letter (all in templatres libary ) with the squedule of charges

    Hi Gabby and welcome. I agree that the other charges are penalties but am less clear about the monthly OD charge. If this was a charge for a service that you agreed to you cannot claim it. If you were only charged this if you went over your limit it is likely to be a penalty. You cannot claim for genuine service charges though.

    I also believe that the £5 monthly charge for overdrafticon facilities is irrecoverable - it sounds like a service to me, and as such the bank is entitled to charge it.
