I was hoping that someone could give me some advice about my claim with Barclaycard please! I sent off for a Subject access request and got most of the statements that I asked for back. I then worked out the charges and interest and sent the "Refund of Fees" letter back to them. 14 days passed so I have now sent the letter again asking them to enter into a silent agreement with me and refund the amount etc but they still haven't contacted me! So now I'm at the stage of having to raise a court claim in the next 7 days! I am quite suprised about this as my claim is for £400 - a drop in the ocean compared to some and I'd be surprised if they took me to court over it! Has anyone else experienced this problem? Am I likely to get the money back or will I have to go to court? Any advice much appreciated!

Stick to your schedule and do not accept anything less than a full refund with no conditions.
Don't be afraid of the court process. Keep it under the £5000 small claims process limit. You can make multiple claims if you have to. If you do have to go to court there is plenty of help available via this site and the court people including the District Judge are very helpful because they realise that claimants (you) are not legally trained.
As a point of information you shold bank on going to court regardless of the fact that most claims dont.
Your started out on a procees which leads to court if the defendant doesnt pay out. if you started on the basis you wont have to go to court, you have misunderstood what you are doing imho.
Sorry if this sounds harsh but we all have to understand that the process leads to court and if it doresnt get there and is settled then its a bonus.
It sholdnt be seen that repayments are provided freely and that oriceedinfgs in the courts wont happen.
You have started so i would suggest you finihs and stick to the programme suggested in the step by step guide, as far as i can see everyone who does this gets thier moeny back.

I have receive a partial refund from Barclay card and they said they would not enter into any further correspondence, this was within the 14 day dealine which was up yesterday. Shall I issue them with another seven days and then start court proceedings. Please help!!!
If you havent started your own thread please do that so that you have a base in whhc to collect all the info offered to you.
Then if you have issued a prelim letter then send the lba.
when they fail to comply issue proceedings at court.
