Hi all, this is my 1st post, been reading like a mad man for a few weeks (and before i registered aswell)
this month alone I have incurred over £200 in charges for unpaid DD's and unauthorised overdraft (they asked me to apply for one but I was refused last year so aint bothering lol)
what worries me is... will they definitely close my account and if so i assume i should open a new one before I proceed
I constantly miss DD's (not every month but regularly) does this count against me or does it not matter regardless?
the reasons i ask this is I am a bit hesitant and therfore need reassuring before i commence... also the pain of moving all my DD's plus wages to another account
I have drawn up all necessary letters before I commence (dont fail me now hard drive hehe) and am 100% ok with the procedures etc
also I havent kept any letters with regards charges as I tend to just accept it and bin em... is this important?

You are advised to get anther bank account just in case but I wouldn`t wait to take the first step until you`ve got another account cos they won`t do anything yet.
It doesn`t matter how many DD`s have been missed. The point is that you`ve been unfairly penalised for them. Also you`ve probably incurred a lot of them because of previous penalty charges.
You say you haven`t got letters. If you have a list of all the charges and what they were for that`s all you need. If not you need to send of a DPA request which you can fid in the Libraries section of the site.

that is my 1st step, which i shall be sending on friday (once I buy some more paper... school holidays grrrrrr)
I would say i have probably incurred a lot of charges in the 5 years with the bank and it would be a nice little windfall i guess. will open a new account tomorrow and then start the ball rolling. I only have a crappy electron card anyway as I didnt pass their credit score for a switch. annoying considering I have approx 2k per month going into the account

Hi G1bbo deffo open a parachute account -in your own time like sparklydayz says, they wouldn't do it straight away, and quite unlikely anyway. If they do they would need to give you 30 days notice. Further to that if you send in a SAR the account would be in "dispute" and I think that means they couldn't close it anyway - but could be corrected on that.
Moving your DD's at worst case scenario wouldn't take that long.
Its your cash - not thiers! Please ask if you need anything as it gets a bit sleepy in the woolwich forum - there aint that many of us!

the funny thing is I am totally against Barclays (overcharged me a few years ago and messed my account around something chronic) if I had known just how much of the woolwich is now Barclays i would have shifted a while back.... SAR going off on Friday for definite, parachute account sorted anyway, forgot I have a Nationwide current account already that i havent used for last 2 years

You should post all letters recorded delivery to your local (or nearest) branch.
You haven't missed the boat, they are still making the charges, and they are still unlawful.
The stay of execution that you may have been reading about is just a delaying tactic. In all the cases I have read about it is simply that the bank have asked the judge to await the outcome of another case, or series of cases. The judge will agree with that, but there is no reason why you can't request the judge to change the decision. No other case is relevant to what you will be claiming since it is a fairly straight forward claim.

the buggers really messed my account about this month, checked balance online on the 1st.... -£100... thats ok cos all DD's paid, then i got a letter yesterday from my mortgage company saying it wasnt paid, checked online and the sly gits had not paid it, took their charges, paid the rest of my dd's and bounced the mortgage, so I got another letter today £35 charges again, plus 20 for missisng my mortgage payment and now a 1 month default on mrtgage as I aint got the funds!!!!

had the letter regarding my complaint etc etc and that they are dealing with it as a matter of importance blah blah... just waiting on the statement of charges now

well just got my list of charges back, only had account 3 years and it totals £979.95 . thats less than I thought but still nearly a grand they have fleeced from me.
quick question, on the letter I got with the list of charges there is a contact number should I wish to discuss further... is it worth ringing or just fire of prelim letter?
I am fully prepared to go all the way but I wonder if their is any negotiating to be had in the initial phases?

dont ring them ! experiance shows they only offer between 20% - 50% of total your claiming ! follow how the rest of us have done it try and keep all correspondance in writing thats your proof in case it would ever go to court its the tried and trusted way! send your prelim giving them 14 days followed by lba giving them 14 days then file your MCOL ! all letters can be found in the templates !

I intially have been sending the letters to woolwich head office at Bexley Heath- and yesterday recived a letter say that *due to the nature of my concerns, my complaint has been escalated to Barlcays head office customer relation team*.
I reckon they are buying time - so be prepared as this may happen to you aswell - whatever happens, still send the LBA out on the set date - that gives them a final 14 days before any mroe aciton from yourself.
