Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am new to the forum and spent 6 hours yesterday reading all the info on the site and then sat down to add up what A&L owe me, £6060 over the past year and a half because I run my own business and putting cheques from customers in the 4 day system as caused cash flow problems. This £6060 is just for dd, unpaid cheques, overdarft charge and the one I dont understand Cleared payment charge of £25 the day put on the account at the same time (midnight) as my cheques clear in the bank, its a big rip off and I intend to get every penny back even if I do have to take it to court, this country is ripping us all off and these forums and others like Pepipoo.com who help motorists with unlawfull speeding tickets, are what we need to get back at the greed of this country. I will be making a big donation to this site WHEN I win, not if I win. I also have an account with First Direct, HSBC & Barclays and a credit card with MBNA & Capital One, Im chasing them all and have sent out the Request information letter to these. Wish me luck
Posted Prelim request for money today 23/08/06 with list of charges template.
Waiting and counting everyday of the 14 days!!!!!
Countrybake, they will not give me an overdraft on my account, this is because in their words " we do not offer overdrafts on your type of account" so I asked to change my account to an account I can have Overdraft on? No was the answer, now I know why! So that they can charge me £25 for each day I go overdrawn which when your self employed waiting for customers to send cheques is very difficult not to, its not like having a perminant job because you dont get paid on the same day each week or month. But will they listen, no not interested because they will lose the money they are ripping me off for going overdrawn, well Im a fighter for Justice and when I heard about this site I was pleased, I will win , I dont give up.
Just checked my account online and low and behold another £50 for 2 days overdrawn this month and £34 for a returned dd, yet it was put on last night at midnight and I had a cheque clear in the account at midnight!!!!!! RIP OFF A&L.
Im getting angry now, upto £6144 now...........
I'm in the same boat as you - £8,300 in charges in the last 6 years. I have split my claim into two dates 2000-2003 and 2004-2006 as this site recommends. Claims for over £5k fall outside the fast track and if your case proceeded as far as a court hearing and you lost, you could end up having to pay the banks costs. YOU WON'T LOSE - but its a wise precaution, God knows they've had enough from you already.
Put in your first claim and as soon as you receive your nice big cheque, start your second claim. I'm at lba stage with first claim. Good luck

On the basis that you will need to open a parachute account I can recommend Abbey National for their business account. OH and I also run a small business. Have a look at their business account. No charges for paying in cheques or standing orders etc and they offer an overdraft facility. We have been with them 2 years with no problems at all and have saved around £50 per month in charges since switching from ltsb. By this I mean service charges - paying in cheques etc not charges for exceeding overdraft. Don't get me wrong, if you were to exceed your overdraft facility I don't think Abbey National are any kinder to you in applying their "penalties" but it may be that if you have no service charges and an overdraft facility you may avoid any "penalties" altogether. Hope this helps and good luck with your claim.
Once I added the s.69 interest at 8%, my claim was over the £5k limit, but all correspondence upto filing the claim showed the full amount (£6k+). When I filled out the N1 claim form, I split the claim so that it was below the £5k small claims limit, intending to claim the balance at a later date - but the A&L paid the ENTIRE amount I had originally claimed, not what the court claim was for.
I don't know if that was an admin cockup or deliberate policy - but it would certainly seem to be worth bearing in mind.?
If it goes to me filing an N1 then I will split it, I wanted them to see what the total amount was, hopefully they will just settle up. Im enjoying this, cant wait to get my requested information back from Barclays, HSBC & First Direct. I wonder if some of the staff from these banks are thinking what a rip off their employers are??????????????
Had a letter back yesterday from A&L in response to my request for my fees to be repaid, they say the usual that eveyone else has had from them that the OFT were refering to credit card fees and have not yet entered into discussions with the banks blah blah blah.
