    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received.     • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.

    • Well naturally if you want to maintain your outrage, and retain something to bitch about, then arguing about the level of your fixed monthly DD is the way to go. You are of course perfectly free to ignore the easy solution.
    • His financial situation isn’t great, and the landlord has made lots of things up. The things he’s put isn’t true at all. My friend did tell the full truth with incoming and outgoing, I helped him fill in his form and he checked bills etc. to make sure it was right. His wage is ok, but not as good as the landlord thinks it is,  and he doesn’t have anything spare. How much are they likely to take from him? Should he send any reply?  the letter just says to take the court letter with him.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've received back all the gumpf from Llloyds as a result of my SAR request for my PPI claim. However, credit card statements have only been supplied since 2004. I took out my first card inc PPI when they were just TSB/trustcard, around 1998 - does anyone know if they should usually hold/supply statements from this far back?

 

They've also neglected to send me the original credit card Agreement as I'd requested, all they've sent is one I'd signed only in 2006 when I transferred to a different card.

Interesting.

I have had a card since 98 also and only recieved 6 years.

 

For the record I did recieve a copy of my 98 agreement in both a cca request and the sar. And I have had 3 different accounts with them in that time(classic, gold and another gold when it was shut due to fraud)

 

Personally I think they do have the statements further back. Ive got bank statements from them back to 1999 although I think at that time these were done more local where the credit card would of been done at Southend on Sea(I think).

 

I'd be interested to see peoples opinions on this.

Also would be interested to hear from anyone who has been sent any credit card statements from further than 6 years eg from 1998 - 2004.

I have now been told by Lloyds that credit card statements prior to 2004 are no longer held - does anyone have proof to the contrary and been sent credit card statements older than 6 years?

 

Also, they say they have been unable to locate a copy of my signed agreement for the account, but they assure me that before they opened the account, they would have required sight of a signed agreement and that if I take the matter further, they are confident in their ability to prove this! Any thoughts on this?

 

Lastly, if I can no longer obtain statements back from 1995, when FOS deal with my PPI claim and if they uphold it, will they only deal with the PPI premiums I can prove were paid over the 6 years statements I have? Could they not even do an estimate of what I would have paid in premiums for all those previous years 1995-2006?

I too have only received statements from the last 6 years - though I was given a TSB trustcard (I did not apply for one) instead of a cheque guarantee card back in the 80's - probably the same as in this link

Could it be possible that you didn't actually apply for a trustcard whizzkid001 ?

The PPI for Lloyds TSB was with Pinnacle Insurance plc - who don't seem to have a lot of info about the policy apart from how much it was per month - probably going back to the late 80's early 90's but they haven't mentioned when the policy actually started. I believe the policy to have been mis sold and I want to claim back the premiums with interest.

I had a Credit Card with Lloyds back in 2003 for approx 1 year (0% Balance transfer card)

I submitted a SAR to Lloyds in May this year for a copy of the CCA and Statements.

 

It took 3 months of trying, including 4 letters of complaint and a phone call, but I got a copy of the original CCA and all statements dating from June 2003 till August 2004. Unfortunately it turned out there was no PPI applied to the account.

 

I know it is only 1 extra year but it does prove they hold records going back more than 6 years.

 

The number I contacted was 0845 070 7124. This is the number for Lloyds DSAR Team.

i have just reeived a pile from the year 2000,mind you they said the same to me i had to sar them to get these statements and i have to add the sar people are a class above the rest of the bandits at tsb ,it about time people power took control and hold a mass demonstration and instited the fraud squad go in
