Sent data protection letter and £10 fee - got statements back to June 2004. They state prior to that statements are on microfiche and not "readily accessible" within the meaning of the data act. They go on to say that these documents do not fall within the class of documents to be produced, subject to an S.A.R - (Subject access request)....but I can request them @ £3 per statement though? Any advice?
its up to you, its a [problem] or at least most believe they are samming you in this repsect, do a search and have a read through some posts on here and in the Abbey thread.
Make a decisiosn about either paying up or taking them to court.

PS i havent paid up they have a few days left yet but i have decided to proceed on the basis of what i have and estimate the rest.
I may enter a claim under the dpa for buggeration factor it will be good experience of form filling for the court and might also get me some more info to boot.

Here is the section from the DPA that I think they might be from where they got the "readily accessable" bit.
"relevant filing system" means any set of information relating to individuals to the extent that, although the information is not processed by means of equipment operating automatically in response to instructions given for that purpose, the set is structured, either by reference to individuals or by reference to criteria relating to individuals, in such a way that specific information relating to a particular individual is readily accessible.
It seems to me that if the data are available for them to send you at £3 a go then they are readily available.
one of the problmes with the DPA is that its perfeclty clear until you try to use it.
readily accesible for three quid would seem to fall within the act to me.

Barclays Bank sent me 6 years worth of statements which most were on micrfiche within 2 days of SAR letter and refunded £10.00 So therefore Barclaycard should be able to do the same. I got the same letter from Barclaycard from Carol Jones Manchester who will not return my calls or speak to me. Mind you last time I spoke to her I reminded her of D.P.A and she has never spoken to me again since...... They have untill 10th November to comply. I have already sent one lba letter which I have had no reponse.
