Oh boy, where to start with this one..?
Firstly, I sent my DPA request three weeks ago but stupidly forgot about recorded mail. I hope I haven't wasted my time there
I had my Natwest account from student days, and they allowed me a £2k overdraft facility. They offered me a graduate loan, and even though I was temping I was confident that a proper job was forthcoming and took a £5k loan. With hindsight this was foolish, and they should not have allowed this given my work situation, but I guess I shouldn't have taken it either.
Within a few months I was no longer getting decent hours from the agency, my account terms changed from graduate to current, the loan was gone to pay the bills, and I was being charged by NatWest, making the problem worse. A couple of weeks on the trot they charged me far more than my pay packet, meaning I could not even afford to fill the car up to get to work or buy a can of beans to live on. I got my pay put into another account, I argued with NatWest and pretty much walked away from the bank/loan accounts. I didn't know what else to do. In February 2004 they notified me of their intention to file a default; I called and asked them to help me (ha!) and it seems that they went as far as (randomly) refunding some charges, but obviously it was far too late. They notified me again in April 2004 that they would file a default, and eventually I persuaded them to accept £100 per month into the current account.
I have kept this up ever since, and have received zero correspondence from NatWest, not even statements. Last month I got a mini-statement on the current account and found I am being charged £28 per month of the £100 I pay in, reasons unclear at this stage. I have no idea as yet what the status of the loan account is.
What I want to know is, whether I get a response to my DPA request or not, am I not entitled to the statements for the past 2½ years FOC anyway? I guess I should give them a call on both subjects...

Can I claim for a "default notice fee" of £30? They might argue whether I would have incurred these anyway, regardless of their penalty charges, but I want every penny I can have from these [insert profanity here].

An interesting sidenote, I checked my credit record online and could not see any mention of Natwest's name anywhere on it - despite their threats to file a default.

Quick update - they obviously received my request since the first batch of statements arrived today, July 2000 to October 2002. (I already have these, which is beside the point)

Second (and presumably final) batch of statements received, time to do some sums... Intrigued about the charges I've had since I last received a statement; none at all from 31/3/04 to 31/5/05, but £28 every month since then. No idea what that's all about, since as stated above I have had no correspondence with Natwest during that period.
One question: several entries are marked "Automated Credit / Loz / MBA" - anyone know what MBA means?

OK 14 days was up last week and I've had no reply. Am debating whether to send lba immediately (so as to negate their time wasting as much as possible) or wait another week so I can add another £28 which I expect to be charged on 30/9/06, anyone any thoughts?

Over the weekend I got the standard reply from Stuart Higley - "there is little I can add constructively to my last letter" etc etc - though this is the first response I have had from them.

Hi,
As there is a deal of controversy about the amount of text you can put on the MCOL form, ( POC ), I would recommend you going down the N1 route, Deal with your local CC.
Does anyone agree ? or is this just " Bull ".
Filled out MCOL today, a grand total of £1405-71 including the 8% interest. That will clear my outstanding overdraft nicely, and probably my HSBC overdraft too. I just hope they don't drag it out... :-/
