Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have sent my preliminary letter to Nationwide today!
I am claiming about £1950 in charges plus about £250 in overdraft interest!
My account is no longer open though, and I owe them £2400
so I don't know whether I'll ever see the money or whether they'll
just take it off the existing debt! (If I get it )
Really greatfulo for all the advice in and around the forums. It has really helped!
Got a payment slip in the post this morning from Nationwide,
saying a cheque for £30.90 has been deposited into my account.
No details of who from.
I haven't had any cheques, and if I did, I can't pay them into that account as it is closed.
No one has received any payments at the stage I am at, I don't beleieve.
And if it is from Nationwide, would it be in the form of a cheque??
Moneyclaim subimitted around 12-50 this afternoon!
Still not sure how they will deal with this
being that I owe them a few hundred less than my claim is now worth and being that my account is now closed!!
Hi, This is standard practice for Nationwide. Hopefully you should get the money in about two weeks, maybe in bits and pieces and maybe not all of it but who knows at the moment.
Thanks Jacqui. All seems pretty routine in that my case is going much the same way as all the successful cases we have seen.
My only concerns at the moment are that I did owe them £2000+ from an account they closed a few months back.
This may leave me open to a counterclaim, or they just might only refund the difference (don't know whther this is allowed).
Being my account is closed, I am also unsure as to whether they will pay into my cashbuilder which is still open or by cheque!
Those that seem to be requiring a payment by cheque have so far, from what I have read, not been successful in their claims, and one has just seen Nationwide put in a defence!
Guess I will just have to wait and see!
But, trying to look on the bright side of things, at least if they don't pay me all the money, it should be a debt cleared!
Im in the sme boat as you. I only filed my N1 at court today.... But i owe Nationwide over £2000 but i have stated on my N1 forms to be refunded by way of cheque. Not sure if i will get it though???
Anyway keep me posted how you get on..

"I'm writing, following your recent correspondence to Charles Bacon in which you asked us to refund charges on your account.
I'm now able to confirm that we've refunded £2445.45 in charges and £120 to cover your costs.
Please be aware that the amount we have credited to your account is less than the amount you have requested on your claim [by abut £100]. We have thoroughly investigated... blur blur blur"
Well, are they allowed to pay money into a closed account?
I am going to send an email to Charles Bacon I think and ask him to credit money to one of my cashbuilder accounts or to send a cheque otherwise I will continue with litigation.
