    Default Abbey and DPA

    Abbeyicon seem to be using the Subject access requesticon process to try to delay and frustrate actions against them.

    When sending a DPA request to Abbey make sure that you enclose a cheque for £10 otherwise it is unlikely that they will act on your DPA enquiry until they have considered and probably rejected your complaint. This means that you could have to wait another 40 days. However, they can't do this if you have already send them payment for the DPA enquiry.

    Please also note that you are not obliged to complete the Subject access requesticon form that Abbey may send you. The request letter and the payment are enough.

    after reading that anoucement, what happens if they send back your cheque and say its a matter for customer services and as i am making a specific request there's no need for a subject accesss request

    Legally Do they still have to reply within the 40 days?

    If they put that in writing then I would say they either have to do what they say they're to do or comply with the Subject access requesticon within the original 40 days. If they do neither then it's a complaint to the Information Commissioner.

    Just to re-emphasise, you need to get them to write to you saying what they are going to do. Don't let them just send the cheque back and give you a verbal assurance as otherwise you may well find that the person you spoke to has been mysteriously re-assigned to their branch in Outer Mongolia.

    Hi,

    The letter said

    "Dear Natasha,

    thank you for your letter, which was recieved here on 13th march 2006.
    I note that your are requesting a complete list of transactions and charges on the above account number, as well as details about any manual interventionthat may have taken place in relation to your account.

    As you are requesting for specific information, Abbeyicon will deal with this without you having to make a request under the data protection act. I have therefore forwarded your letter onto our complaints department for them to deal with and they will be in contact with you in due course. The information will be forwarded to you free of charge and as such i have duly returned your £10 cheque.
    If the data you receive does not satisfy your requirements, you still wish to make a Subject access requesticon under the data protection act. I have enclosed an information sheet outlining our procedures.

    I trust this meets your requirements.

    I also received exactly the same response from Sheena Small, also dated 13th March. Have you received a reply from the Compaints Dept. yet? I have not had a response as yet and have posted a letter ('signed for') today as follows:
