    Default Quinn v NatWest. *** WON ***

    Well,after reading this site,the time has come for the wife and me,to reclaim the stand and deliver fees,that the Natwesticon have levied upon us,in all the years that we have had an account with them.

    The S.A.R - (Subject access requesticon) letter has been drafted,and will be posted,recorded delivery,tomorrow,and the process will then begin.

    An update will of course be posted,in accordance to the events as they unfold.

    Could be an interesting one though,as we have had an account with them for 20 years.

    Wish us luck.

    Next stop:The Halifaxicon.

    Well,I have an update.

    Copies of the statements for the bank account arrived today,so fair play to them for getting them to our house in such a short space of time.

    Unfortunately,because I'm working over the weekend,it will be Monday before the wife and I can go through them.

    I'll let you know once we have done so,what amount they may owe us.

    Change of plan.

    She who must be obeyed,decided she wanted to go through them this evening,and we've come across £1195 in charges.

    However,we now have to go back and re-check,and deduct the AG fees that we had,as at one point,the Nat West started to lump them together,and we will have to seperate them from the O/D fees,but we still reckon on them owing us circa £1000.

    We've now sat down and calculated it all properly,and according to our figures,they owe us £985.

    We've put it all together,using the spreadsheets,and will send it to Bishopgate tomorrow,and see what happens.

    Further update:

    Got the,'We are not to blame' letter today,and interestingly,one of the paragraphs in it reads:

    'Having reviewed your accounts,I can find no instance where charges have been applied when they were not properly due.They have all beena ssociated with a lack of covering fundsin the accounts at the time items were presented with payment.Accordingly,the charges applied to your accounts,must stand.'

    Furthermore:

    'In your letter you have claimed that we have been acting as your fiduciary,yet I am unsure of the basis of your contention.This does not form part of the normal banker/customer relationship.'

    I also note that they do not accept the OFT's findings,of the 5th of April.

    So what is my next step,people?

    Ok, get the letter together and send in the lbaicon letter which can be found in the templates libraryicon in my signature at the bottom of this post. Send that in inluding the spreadsheet including all your calculations but not the 8% interesticon as this is only claimable at court. You can send this LBA letter from now as they have responded to your intial letter.

    My advice is only my opinion, I am not a legal expert.

    Got the 2nd 'Get lost' letter today form Stuart Higley again,and it reads like this:

    Dear Mr Q.

    Yes been there.

    When sending my original request to the bank,I did the spreadsheet,without the days accrued,and intrest charges,as advised,but when I now go to copy and paste the details to a new spreadsheet to include the days and interesticon,it doesn't calculate them.Why?

    Also,can I copy and paste this information to the MCOL page when I'm making the claim?
