A quick question, if you were miss old PPI and were still paying the loan off on reduced payments, if you won your case would they have the right to take the amount you claimed off the loan amount?

It all depends what was written into the agreement you signed, you would have to read the terms and conditions to see if there is anything about set-off.

Thanks Pompey, just considering having a go at reclaiming. Was going to get in touch with on of the firms on TV but have been having a good read on here and considering going for it. Will have to send a SAR for the agreement as cant find it anywhere,
Couple of questions though, if you have defaulted on the loan is it still possibe to claim? Also my partner thinks he saw something on TV which said 'Claim while you still can, before April' Is there going to be something which prevents a claim after a certain date or has he imagined this?

Forget the bull on TV they are just after your money, you can do this yourself its not hard and you get all the refund and not only 75% of it.
Nothing is happening in April that I know off but quiet a few claims companies use the 6 yr rule wrong in that they say you can only claim back 6 yrs worth or back until 2004 this is wrong as it was mis-sold in the majority of cases.
The 6 yr rule comes under the limitations act and it means that you have 6 yrs to make the claim from the time you realised the mis-sell.
I cant see no reason why you cannot claim if you have defaulted and that is a good argument in its self in that if you did not have the PPI your payments would have been lower in in some cases by quiet an amount so maybe in that situation you would not have defaulted you see what im getting at ?
So yes go for it and if they can set off an amount the most they can is to recover the defaulted sum.
