Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I claimed DLA on the 22nd Jan 10 reason was a stroke I had in April 1990 I did not claim before for two reasons 1) I did not know I was entitled and two I was working until September 08.
I have since been to the CAB and they told me I should claim and that I could of done years ago as it is not means tested.
I am currently on I.B long term rate, anyway the CAB helped me with the form as it was a pain in the a**.
Yesterday I got a letter from ATOS saying that they will contact me shortly to arrange a visit so does this mean they will visit my home or will i have to go somewhere the letter was not that very clear.
Also I have read bad reports about ATOS on here and other boards so to that end can anyone that has been though this medical give me any tips and/or websites that will help me.
Thanks
Regards
PF
Oh p.s on the I.B should I be getting a disability premium and if so how do I go about this a bit confused.
As far as I know, they will send you an appointment to go to them. Not sure what happens if someone is housebound - presumably they would have to visit you at home.
Right just found out after a lot of searching that ESA and IB medicals are carried out at a medical centre, but most DLA medicals are carried out at home.
Thanks for the help so far just need to find someone who has been though this now to find out what it is like.
I can't say for definate but when you claim DLA, I think it is a home visit usually, it was in my case. I would personally would ask for a home visit anyway, bearing in mind how shambolic ATOS medicals are anyway, I would suggest that if you go to them you don't stand a chance, not that you do at home either
In my experience the medical was a laugh! The doctor, or should I say former GP took details of all my medication, as long as it was boxed and had my name on. He asked me all about how my problems affected my day to day life etc and then went away and wrote a wonderfull work of fiction that could win the Pulitzer prize. He never saw me walk, he never asked me to but decided in his report how far I could walk, in what manner and at what speed, absolutely amazing! He commented on how many stairs we had to get into our flat from the front street, (he arrived that way) and asked how often I used them (we have a seperate entrance at the back with less than half the stairs due to the way the building is built). I told him I hadn't gone in or out that way for over 12 months and only went out anyway using the back way no more than twice a week on a good week. He went away and said I used the front way 4 to 5 times a week without a problem! Nice!
I could go on but I think you should get the idea by now. They lie and make up whatever they want to. I honestly believe that if you had no legs they would suggest you could walk into town twice a day unaided.
Do not trust them one little bit, (in my opinion of course)
Don't give up Pompeyfaith, you deserve the money. It may be a pain, but I think you're a fighter. You know how awful Atos are, but the more people who stand up to them and try to make the problem more widely known, the better.
If it turns into a fight, we'll help all we can, won't we guys?
F DCAs posted recently about a BBC journalist who's researching a programme on these rats. I wonder if he'd like to attend when Atos visit
Mr Hendry is still interviewing people at the minute, and we've traded emails.
From what I'm led to believe, it seems there is no small shortage of people he can find willing to express their opinions on ATOS. He's interested in on-camera interviews as well.
[Sigh] - another of the fraternity, aren't there a lot of us? I 'failed' my IB assessment by the lovely Atos people, but won at appeal. I thought the tribunal people were very fair, but it certainly takes time.
Its all in a days work for the ATOS doctors trying to get the bonuses by getting sick people to work.....I am really saying this! Yes it happened to me few weeks before my major surgery and removel of part of my repoductuctive system with a huge lump....she said(ATOS DR) knowing of this alone 'A back to work can be considered within three months' they stopped my ESA and for over a month i had no money because they were playing around with my appeals letters etc.
I ran my home for weeks with just the childrens tax credits/child benefit, got into debt, lost our little car and put me into a break down all this on top of my surgery which i survived to only come home to more complaints and no money.
As i said its all in a ATOS docters working day to make the sick sicker even die by making them go through months of misery making complaints that go no-where.
All mine is being dealt with by the Ombudsman thank God!
One piece of advice I would urge is to audio record the medical, because Atos WILL tell porkie-pies when drafting up their report. Don't tell Atos that you intend to do this or are even thinking about doing it - just do it. If you don't, you'll wish that you did.
There's a Youtube clip called ATOS Healthcare that's in two parts which has had surprisingly few hits thus far, but comments of that clip have all been extremely positive.
The BBC journalist's name in question is Philip Hendry.
Pompeyfaith, I really wouldn't start getting stressed at this stage. Right is on your side, and as someone said earlier, it could be long but I think you will win out, honestly.
Pardon the pun, but please keep faith. We're all with you.
Atos will get their come-uppance, if there is any justice in this world. In the meantime, please keep communicating with us. You'll be OK.
