Hi all, new member here,
on feb 19th i went for a medical,but ESA was stopped on the 18th feb??
The fact im concerned about is that i was never contacted to say my benefit had been stopped,and only when i had a back to work interview at job center it was brought to my attention,albeit 27 days after my benefit was stopped,
i have appealed and got a letter of confirmation,and from my understanding will have my benefit re-instated,
but only from the date of my appeal letter,
how do i get it backdated,bear in mind i was never informed of benefit ceaseation,
therefore it affects my housing benefit and council tax benefit,plus almost 4 weeks without any money,
the system is a farce,,and causing me untold grief,
any help most appreciated:-|
For what reason was your ESA stopped? If it was because the medical deemed you fit for work then yes you will get benefit re-instated at the assessment rate. (The dates not making sense will be because of the way benefits are paid, in arrears so if it was because of the medical you will be due up until the day before it). You can ask for a backdate on the grounds that you were not notified at the time your benefit was to be stopped.
Advise the council you have appealed and they will re-instate your housing benefit/council tax benefit; provide them with verification of no income for the period and they should backdate that too.

The same thing happened to me all my complaints were sent to Parlimetry Ombudsman some weeks back and will be sent back to go to last stage with all concerned and then if i am not happy the ombudsman will take up my case of ATOS JCP the handling of my ESA benefits etc.
I have kept a record of all phone calls letters i recieve were all scanned and copies sent to my local MP and a i set up a system in the computer with all scanned letters etc.
When they stopped your ESA they should have informed you by letter before the letter that gives the points to why you were failed and information on how to appeal/or sent a appeal form...THEY DO NOT SEND THIS FIRST LETTER
They also say in the letter you get so many days or weeks later we sent you a letter on the XXXX to tell you your ESA has been stopped ...THEY DID NOT they have lied
ATOS also cover for their Dr's i proved she was wrong many times and she lied/misrepresented me/dignosed me and have the evidence. I am trying to find where this Dr can be reported GMC i believe are of not much help...I will contact them when my paper work is back.
They also have a knack of losing your sick notes and then stopping your benefits
Did anyone have major surgery due and their ESA or IB stopped?
