    Angry Merz v A&L

    very angry of col chester here!!!!!!!!

    For the last 6 yearsicon I have suffered the constant opening of a wound which I feel very angry about. I had been in debt in the past through one of those nasty store cards and had only just pulled myself out of that hole by hard work. The start of my present dilemma was when my new employer promised that my wages would be paid into my account and they were not. My bill payments are set up all to go out at the same time and all the direct debits set up for those payments failed and I was charged for each one which totalled £210 which felt like my bank kicked me while I was down. Since then this has snowballed each month with my account falling into serious debt. A&L helped me out with an overdrafticon which they charged for the pleasure.

    I have sent out the first letter asking for the charges to be refunded and got the standard letter stating that they are fair charges. I am now going to send out the next letter and will keep you posted on the results.

    sent out second letter re-asking for repayment of charges and got same generic letter stating that the charges are part of the terms and conditionsicon HA HA! BLAH! BLAB!!

    Hey, Merz, by 'second letter re-asking for repayment' do you mean you asked them nicely again? or was it an actual letter before actionicon?

    They will only take you seriously if you are following the tried and tested route.

    it was an actual "letter before actionicon" and they sent in response the exact same letter again.

    i am now going for MCO now and see how they react.

    just to clear the air on this i was angry with A&L but now i am getting even. I have been fighting to stay afloat money wise and now its time to get back what is mine!

    while filling out the MCO form i am stuck on what to put in the Particulars of claim bit. should i use the http://www.consumeractiongroup.co.uk...hard-copy.html template or the http://www.consumeractiongroup.co.uk...oneyclaim.html briefer version as you are only allow to have 1080 charactors or 24 lines?

    help!! i am so close and don't want to make any silly mistakes.

    andymerz, I notice your claim is over the small claims limit of £5000 so you should consider splitting it into 2 claims in order to stay within the limits. Consider yourself lucky to get a reply to your lbaicon, mine was met with a stony silence lol.

    A&L paid up, put the cheque into another but when I went to MCO I get this message "The Defendant disputes the whole amount you have claimed. Your claim cannot proceed on-line and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."

    does this mean they are going to try and get my money back?

    Andy,

    A couple of question come to mind. First when did A&L send the cheque? secondly have you read the accompanying letter fully?

    Th reason I ask is that A&L seem to acknowledge a claim and state they are going to defend it in full then send the cheque, at that point you cannot continue online and it gets transferred to a normal court. Their defence is usually to send a cheque. If your letter follows the one I got then they will have asked you to write to the court at Northampton to notify them the claim has been settled. You need to do this fairly quickly and also send a copy of the letter to A&L for their files.

    No I doubt they are trying to get the money back and congratulations on the win

    Also PM a Mod so your case can be moved from the litigation section.

    Don't worry, they would be doing a counterclaim if they wanted the money back. They just say they will defend as this gives them 28 days to avoid a judgment against them instead of 14. It's just a precaution as far as I can see in case they are slow sending cheques out.

    They actually did submit a defence on my claim a couple of days after I received the cheque , the defence basically was 'The claim has been paid in full'

    Thank you for replies which have helped greatly.

    I received with the cheques a letter stating something very similar to other letters received by those who have had their claims settled. The letter does not mention the default notice removal I requested from them.

    I am not sure how to approach them about the subject as I want to send a response to say I have received the cheques but to not close the door to me being able to remove the default notices against me.

    Andy,

    Did you include removal of the default in your claim? if you did then your claim is not yet satisfied and I would write to them telling them that.

    If it wasn't included then if the charges were for more than the default value you have a good case for another claim to remove it.

    Does default value refer to how i was charged before interesticon?

    Do I need to go through the MCO again?

    Sorry but as you can work out I am very much at a lost as to what you are going about in the second paragraph.

    By default value I mean the amount they defaulted the account for, this is usually the amount of arrears, and its the amount they quote to avoid a default notice. If that amount is less than the charges then you can probably have the default removed on the basis that the charges caused it.

    As you didn't include the default on your claim then they don't have to remove it as part of your claim settlement
