    Default Are Black Horse in the right?

    my mother took out £20,000 car finance with black horse but passed away only4 months into the agreement. The car had to be handed back, but they informed me (the executor) that thay had auctioned the vehicle for only £3500 and that there was still £16900 outstanding on the agreement.
    I think this is extremely unfair that a 4 month old ford mondeo could be
    sold off for such a tiny amount. If I had known that is what they were going to do I would have sold the car myself and paid them what I got and then paid the balance.
    Do I have any chance of redress if I complain?
    PLEASE HELP!!!

    No it can't be right.

    If you complain through normal channels, it will be very time-consuming and very uncertain as to the outcome.

    Was their any PPIicon on the finance?

    my mum passed away in 2008 but the first i heard of it was last year.

    Firstly, please start a new threadicon on this in the appropriate forum. you will get more help and support there.

    Please post a link to that thread here.

    Secondly, I Black Horse are regulated by the FSA. I would suggest that the first step will be to identify exactly which are the FSA regs to which they are subject.
    This won't be easy to find out. They won't want to tell you.
    You will be best off trying to do this on the phone - but you must record the calls. It is by recording the calls that you will get evidence of their unwillingness to help and of their general unfairness.

    If you can't record the calls, then do everything in writing - but be warned, you will find this a frustrating and longwinded and maybe futile experience.

    I suggest that you get a truecallicon installed before you start work on this.

    I am quite sure that if they have sold at an undervalue like this that they have failed in their duty towards you and that you will be able to get your money back or the debt written off.

    However, they will resist you all the way.

    Because this is going to take so long, I would aslo start a complaint to the fosicon. You may as well get it underway but I hope that if you put enough work into it, that you will have the evidence you need to cut short the FOS complaint and to go directly to court.
