had no reply other than an acknowledgement, so sent them a lba yesterday (18.8). today i have received a letter enclosing a cheque for £20 as a goodwill gesture.
they say that the £200 referral fee was imposed by the Outside Agency, & not by Amex. it was in fact a DCA i paid.
so does this mean i have no comeback on this £200?
also, (i need to know that first of course), can i get back to AMEX & say 'fair enough, but please can i have the other £50'?
sorry, my table didn't come out in the post like it looked before i submitted! we are talking £70 in late payment charges, then £200 when they referred the debt on (very swiftly & i'd been a flawless customer for years)....

I have been brought to the brink with bank charges in this last year as I have had so much financial trouble with an ex-husband! It has taken me over two months to get the bank statements with charges from the bank for the last four years. By my calculations of a maximum of £12 per charge - the bank now owes me approximately £3000!! I am about to calculate the 8% on this and then write and ask them for MY money!! I am heartily sick of large corporations and companies sucking the life out of their customers/consumers!! Wish me luck please!

Firstly, hello to you Mel, yep, you can get your £50 back, just follow the instructions as anybody else would.
What was the £200 for? This was added by your bank?
Annette, why do you say maximum of £12, your charges were likely a lot more than this? Have your statements not arrived yet?
I really think you need to read a lot more as you don't have a good enough grasp of the whole process, take a couple of days to absorb as much as possible, this will save you a lot of trouble later on.

they say the £200 was added to the amount i owed but not by them, by the debt collection company. i actually paid Credit Solutions by phone immediately upon receipt of their letter of 7.5.2002, & i've dug out that letter. It states that the £200 is 'in accordance with Section 6 D (iii) of your Cardmember agreement'.
Not sure if that makes a difference., I would appreciate your views on whether i can claim any of the £200 back (bit steep for a letter), & if so who from.
If i can't claim from Am Ex, would I send them a revised lba for the £50?

i've read that thread Crusher. interesting content but it doesn't apply to me as i unfortunately coughed up in full out of fear at the time.
are you suggesting that i pursue Amex for the £50, & the Credit Agency for the £200?
i don't want to sue a company who can turn round & say it has nothing to do with them so i need a way of finding out who is responsible for levying the £200. otherwise i guess i'll have to drop it & feel even more cheated than i did before i saw the glimmer of hope of revenge.
I would imagine it's the debt collection agency, so it's them you will have to chase.
Get back your £50 from Amex, and the £200 from the others. If it is an unlawful charge, the same principles apply, the letters in the library should suffice with a little alteration. What does the £200 relate to? Writing a letter? It's pure profit extraxcted from one who can least afford it.
If you are unsure as to who levied the charge a couple of phone calls should clear it up. (I think it's the agency though)

I think I'll send a revised lba thanking Amex for the £20, pursuing the additional £50, & advising that I'll pursue the debt collection Co for the £200 (on their advice as to who raised that charge), but will be back to them should i discover otherwise.
The £200 is described as a 'referral fee'. Am Ex said it 'would be applied', the Debt Co that it 'has been applied', so no clues there.

On the Moneyclaim, should i claim the £70, or the £50 (as i have their cheque for £20)?? I've worked out the interest on the full amount (£70), which i want to claim in full, but don't want to complicate matters.

Crusher i was worried they might stop that cheque as i refused it! Also the interest is £25 (on the £70) as this all happened in April 2002. I want to claim the full interest you see! Unless that's not feasible???
