    Default Wonga / Grosvenor Bailiffs

    Hi,
I stupidly took out a loan with these w*****s sometime ago (over 90 days) and informed them before my due date that i was unable to repay in full and asked if they would allow me to repay my debt in 3 monthly installments to clear. I was advised that i had to let my loan default before they would allow me to make a repayment plan, so this is what i did. Ever since then all my requests to make a repayment plan with them have been ingnored. Ihave emailed them repeatedly and only receive the "please call out collections team" email. To which i have replied - i request that all contact be made in writing only, etc. I have also written to them. So i continued to email them asking them to accept my offer, refrain from adding charges and interst so that what i pay reduces the amount i owe - they have ignored this and my original loan amount of £350 - has increased now to over £900!!!!! can they do this???
Anyway, i received a letter form barker & lowe and an email - to which i replied stating the above and that i have copies of all my emails - that they have choosen to ignore, etc. Again emailed wonga (even though they are the same people arent they??) and still get please call our office - they still continue to ignore my requests for their bank details to allow me to make any payments.
So this morning i receive a letter from Grosvenor Legal Servces / Bailiff, threatening i need to pay the full o/s balance in 7 days of they will commence legal action to recover the debt. such action will result in legal costs being added, etc etc.
What do i do now - there is no way i can pay this in full and surely after trying to resolve this with wonga soooooo many times - and asking them to not add interst and charges - i dont see why i should reapy the £900 +!!!
I have contacted wonga direct again today asking them to accept my payment plan and provide me with bank details and to reply to me today - so far...no reply! no suprise there then!!!
Can anyone please please help me - what options do i have - where do i go from here???!!! am worried sick - i still live with my parents and really dont want them knocking on my door!!
In no way am i trying to avoid repaying this debt - but if they keep ignoring me - what am i supposed to do?
    PLEASE HELP ME!!!

    Hi green

You are doing the right things make sure you keep copies of all correspondence. They may be bailiffs but they are acting as debt collectors with you unless they get a court order. I would then write to grosvenor making a monthly offer for the original amount and one set of interest.

Are you able to discuss with your parents? They might help you?

    Hi Green79,
Ignore post 3, twice he has been on these forums about Grosvenor so he's a bit annoyed because he has not hit his monthly bonus targets (oh dear, how sad ).

Well done for asking everything in writing, if they do phone just say everything in writing only and hang up.
Lets see if they have the right to collect, did you fill in an application or online?
Send Grosvenor a CCA request and post up what they come back with.
Print your name only and send by recorded delivery, keep a paper-trail including any post receieved including the envolopes.
Grosvenor then have 12 + 2 working days, if they fail to respond, send the account in-dispute letter in the templates section until they supply you with an enforceable agreement.
CCA template in the template section.

When or if you get anything back remember to remove all your personal details, barcodes and reference numbers and the amount.

    Best Wishes
    Stigman

They MAY apply to get a court order, they MAY not.
They MAY apply and NOT get the order.FACT.

If the purpose of your stupid statement was to further worry a poster who was already worried sick, you are about 6 months to late.
The op has not updated regarding a court order since march.

If in FACT they had been granted a ccj, then that would have been a ccj on the OP and not the property, which is the second stupid FACT? THAT YOU have placed on the other wonga/grosvenor post.

Grosvenor are overstating their powers in this case and need to be reported to the Ministry of Justice, a bailiff CANNOT exercise their bailiff powers when collecting on a civil debt which has not gone to court. You also need to report Wonga to them as well.

Report both companies to Trading Standards via Consumer Direct, the Office of Fair Trading and the Information Commissioners office. Their tactics are really nasty and they need to know that you will not lie down quietly and pay their extortionate default interest rates and massive charges.

I have yet to see Wonga or their cohorts get an order in all my time on this forum. A risky business (and expensive!) going down the court route. No doubt in the future Wonga may try it as others have with mixed results.

all the more reason for everyone to retain all e-mails recieved, and show their lack of response to offers sent.
proving circumstances, asking for help to resolve your problem, offers made and ignored so that they can at least treble the amount
