Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I posted my DPA off to Barclaycard on 15th August and received some statements through today with this attached:
Dear *********
Further to your request for personal data held by Barclaycard, please find enclosed a copy of the relevant information from June 2004.
Statements held prior to June 2004 are stored on microfiche. The statements copied onto the microfiche in date order and more than one customer statement may be held on an individual film of microfiche.. These statements are not stored by reference to account number of customer name and are not "readily accesible" within the meaning of the Data Protection Act. These statements are therefore not retained in a relevant filing system and therefore do not fall within the class of documents to be produed pursuant to a Subject access request. They can be obtained from our Customer Services Dept at a cost of £3 per statement.
Furthermore, we are unable to provide a computer printout of your transactions on your account to date. Our computer systems do not permit us to print such historic data. Neither do our computer systems allow us to search for and identify individual charges applied to an account. It is therefore not possible to provide you with a printout of such charges. I would also add that Barclaycard did not introduce default charges on it's accounts until mid-2001. The statements that have been provided to you contain the information that we curently have recorded relating to charges on your account.
This information is complete in respect of the above account relationship with you at the time of extraction.
Should you have any further questions regarding this matter please do not hesitate to contact me. If my reply does not meet with your expectations you may utimately be eligible to refer to the Financial Ombudsman Service.
If I have not heard from you within 8 weeks from the date of this letter, I will close my file in acordance with usual practice.
Yours Sincerely
Deborah Woodcock
Customer Relationship Manager
So do I just claim for the statements thats I have or what.Sorry Im problably being thick.I have seen something about microfiche and the Abbey but does the same apply to credit cards
Hi
You're not being thick, but you could do with some reading on this thread
You got the usual response, and yes, you can fork out the GBP 3 per statement (claim it back later), or you can threaten to drag them to court to get them to provide you with the info you are asking for.
Take a look at my thread "Warms vs Barclaycard" and you'll find the same letter there and my reply.
Like I said, read a few more threads concerning Barclaycard (maybe the step-by-step guide in the FAQ section, too!) and you'll get a better picture of what is going on.
Good luck!
Whatever I post is just my opinion, no more, no less!

I will follow you, I got the identical letter back from them.
I then wrote a second letter to them telling them they must do better and try harder, and I want my statements.
there second reply was almost same as first reply.
i am just a bit stuck at the moment what to do next

Do you have your own thread?
You should post in there, not hijack this one
Yes, it's up to you what to do next - I'm going to take some time to read more and make up my mind.
Good luck
