    Default Clamped with a passenger in car

    My parents were clamped over the weekend. Because there were unsure of the parking restrictions around that side, my dad left my mum sitting in the car. Park Direct came along and pointed out some signs which were high up and clamped the car with my mother sitting in it. They had to pay £250 to get the clamp off. I was totally disgusted when I heard this as they are both on pensions. I didn't know it was possible to clamp a car with a passenger in it, is this legal?

    Hi Sonia,

    It's legal but there are other some rules that have to be met. You will likely have to go to court to get your money back.

    If you look in the stickies section at the top of the forum there is a guide dealing with clamping on private land in England and Wales. Have a read of it and if you have any question post back.

    Clamping yes, towing no.

    But this is a civil issue - you need to be in a position to consent to being clamped. Searching for instructions means you didn't actually consent to being clamped. Unless 'Park Direct' can beam instructions into your brain, you could not have had a chance to agree or disagree with their signs.

    Find out who employs the clampers / the landowner. Suing them in small claims will mean you've more chance of getting your money.

    How did you pay by the way? Credit card by any chance?
