    On all my documents I have from the company including my credit agreement it states that it was bought with a personal loan or Fixed sum loan agreement with no mention of conditional sale. I was under the impression thatI was the legal owner of the car, otherwise surely the company would of took measures to recover the vehicle.

    It is not an incorrect flag. Although you thought you had a personal loan, they've secured their interesticon on the vehicle preventing you disposing of it until the payment is made in full. The mere fact you borrowed the money from CMF should have alerted you to this.

    If (for example) you took out a Personal Loan from the TSB, they would not know anything about the vehicle, and there would be no HPI flag.

    Recovering the vehicle isn't always done because this is subcontracted and the cost of doing so often make the amount owed balloon to levels that would not be defended in court, so they take more softly-softly approach, whilst still profiting from you... if they can!

    That makes sense, but who is the legal owner of the vehicle then. they have said I can return the car and they well sell it at auctionicon but I belive i will get very little for it and still be left with the rest of the balance.

    For that, you'll need to reaad your original agreement - which will make this stipulation.
