Just needing advice on my house repossession debt of 23,000. This is mine and my ex's debt. GE Money repossessed the house last july. The mortgage was taken out in 2005. Direct Legal Collections are now chasing me for the debt. Could anyone please help me with my next move. I have sent a letter to them asking for a copy of the consumer credit agreement to see if I can contest anything, knowing my luck I won't be able to. Will my ex have to pay half of the debt. She's gone AWOL. Just need advice on my next action.
Have you received a court judgement for the amount?
You are entitled to a full account of how the sale of the property was conducted - you should send a Subject access request to GE by recorded delivery. They will then have to send you all the paperwork concerning the repossession and sale. They are obliged to market the property in your best interests and if they have not done so you can challenge the amount they are claiming.
Hi and thank you for your quick reply. I sent a letter I found on the internet asking for certain info i.e how was the house marketed, maintenence fees etc.. I haven't received a ccj as of yet. Due to the severe nature of my relationship with my ex I left the house naively in Dec 2007 and have been living in rented accomadation ever since. Repossession at the time seemed my only real option. I have heard that under some circumstances some CCA's written before 2007 didn't cover all consumer right criteria. Apologise for going on.
Yes, wait and see what you get back. It might be a good idea to send DLC a copy of the letter you are sending to GE (again by recorded delivery) - just write a covering letter:
