Arrears Notice Then Demand For Total Of 3 Accounts But No Default Notice!
Writing on behalf of a family member.
2008 financial problems resulted in getting into arrears on loan.
Late 2008 received this arrears notice for their loan...
Then 10 weeks later at the beginning of 2009 they received this demand for immediate payment of the full amount on the above loan plus their 2 bank accounts....
Then 4 weeks later they received this arrears notice for the same sum [total of loan plus 2 bank accounts]
They requested a copy of the CCA for the loan and received a copy with iffy signature of family member and different copy of bank signee's signature.
Requested SAR and the reams of printout confirmed that no default notice was ever sent.
It also stated that they had no copy of the agreement which explained why there were iffy signatures of the [reconstructed/Blue Peter jobby] agreement that they had sent.
Challenged the PPI element of the loan and ding donged letters for sometime and eventually offered premium back but very little interest added on--this 'offer' was only available to accept for a short while.
Wrote and requested increase in interest but they declined and offer expired.
Chased by DCA,sent bemused letter but letters continued to arrive and were ignored-they had no phone number so obviously no calls received.
Latest letter arrived offering ''discount'' also ignored.
Given all of the above can they continue to ignore efforts by various DCA's as it would seem to have been the most awful procedural cock up on HSBC's part in not issuing any default notice apart from lumping together three accounts and demanding full settlement.
My reading is that HSBC have less than a cat's chance in hell of ever legally recovering any money but I'd appreciate the view of others on all of this.

How old is the loan and how much was it for.
Taken out in 2006 for around £6k.
