I have not heard from Egg since I sent them the Data Protection Act and cheque. But, I have accessed my credit report and Egg have defaulted me! I have never received notice of this. I was late paying a few times about 18 months ago, but this was for a short period and I have for the past 14 months made contractual payments (higher than the minimum) -this is not reflected in my reports as it does not state in any way that payments are being made to the account. Also, since being with CCCS and on a Payment Plan, I have increased the amount that I pay my creditors twice.
I have also checked my Egg emails and have never received any such notice.
I am now unsure what to do as I am in the process of claiming for bank charges -is it wise to pursue the default separately? To be honest, I would rather this was removed than pursue the money as this is detrimental to my credit score for 6 years.
Any advice much appreciated. Many thanks beforehand.

I have now received a letter from Egg to ask for ID to verify my details. Sent this on the same day with a letter.
Time wasters -they don't actually write to us to check that your details are correct when taking money from our accounts -do they??
Also, can anyone advise me on the best course of action regarding the default with Egg -which I never received in writing. At what point do I write to them about this? I don't want to over complicate things by pursuing this and claiming for bank charges at the same time. Or is this ok?

The ID I sent to Egg was returned but I have still not received any statements!
Can anyone advise me on the best course of action? I also want to pursue the issue of the default they placed on my account without sending me notification.

Received statements via recorded delivery 11/10/06. Lots of explanatory notes so lots of reading and ploughing through. The notes were obviously written to put people off making claims!
They will receive mine as soon as I have filled in the spreadsheet...
I will also be applying to have the default removed - has anyone had recent success with this? to whom is it best send the claim to?

I am modifying the letter to Egg to include the claim and removal of default notice but I thought I'd check who was the best person to send it to?
Can anyone tell me? I am also keen to know of anyone with a similar claim that has had a default removed. Would be really useful the wording of such letter and who they were sent to. To be honest, I am more concerned with getting the default removed than I am the £200.00 although both would be fantastic!
Due to the default notice (and the ones issued by Barclays!) I am having trouble getting a mortgage as I do not have 10% deposit which is what I am being asked for.

Received letter from Ema Clayton at on the 16th November. Standard paragraphs that reminds me of the credit agreement blah blah blah, that they don't think the charges were unlawful etc etc.
Two of the paragraphs are obviously aimed at scaring me/claimants
-and they have!! They are nasty and have tone of blackmail...
4. We should also point out that it is Egg's policy to terminate the account of any customer where, in Egg's view, the bank/customer relationship has irretrievably broken down, for example, where a customer issues legal proceedings against Egg on the basis of a disagreement over Egg's standard terms and conditions. If you do not wish to take this matter further then we suggest you consider seeking independent legal advice.
5. Where a customer's account has been terminated, the customer is obliged to repay all outstanding amounts due and owing to Egg within 30 days. Where amounts remain outstanding beyond this period, Egg will consider taking legal proceedings for repayment of the outstanding sums. Where the termination is done by reason of the customer issuing legal proceedings to recover moneys owed will ultimately lead to a county court judgement being registered against the customer (which could affect future credit status).
My situation with Egg is that I still owe them £1,700 which I have been paying via CCCS for about 18 months at the rate of £65.50/month. I cannot afford to repay the full amount if they closed my account and it would be extremely detrimental to me if they issue me with a CCJ. On the other hand, they have already put a default notice against my record and this is one of the things that I wanted to pursue with them -almost more than the money!.
I don't know what to do about this and feel very wary to take things further and cause myself undue worry for the sake of £200. On the other hand, I feel totally intimidated and angry.
Please advice.

I have battled with Egg re: my credit reference agency file, they appear to take no notice of letters.
In the meantime, it might be a good idea to write to Experian and Equifax disputing the Default. However, you require correct assistance from the mods., on how to go about getting the default removed, that is if it is 'Unwarranted, Unjustified and causing you distress'.
Thank you Kazzaw and Angry Cat, really appreciate your concern about my case with Egg. AC, what is your current status with them? did you owe them money when you pursued removal of your default notice?
To be honest, all this is to do with Barclays and the fact that took so much money from me in the way of charges -my claim with them is for £3,300 and they too issued me with default notices which I want to apply to have removed.
I will post this in the general forum and maybe alert one or two of the moderators to it.

It certainly doesn't seem right that they can go back on their agreement with you to accept £65 a month. What is CCCS? If you have a letter of agreement and proof that you have been maintaining these payments it seems scandalous that they would have grounds to renege purely on the basis that you are claiming back money they weren't lawfully entitled to take in the first place. It sounds like an intimidatory tactic. I hope someone else can clarify this for you.
What they say is correct in that their terms and conditions state they can close accounts and demand the outstanding balance but I'm not sure how this would be looked on in court particularly after they had refunded penalty charges. I was in a similar situation about 15 years ago an was taken to court by Natwest, the judge reduced the amount outstanding by £4k because it was mostly interest and charges so it doesn't always go entirely their way!!! still got the CCJ tho, not sure it has a more serious effect than a default if you already have one on your file.
Not sure I would let them intimidate me into dropping a claim when you have the backing of a CCCS payment agreement behind you too, your call though.
