Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I recently switched building societies from Nationwide to Halifax. I wrote to Nationwide at the end of January asking them to close all accounts with them. I didn't hear anything back from them and so stupidly assumed all was well.
I got an automated call on Friday (5th March) from Nationwide telling me that my account was overdue by £320 due to bounced dd payments, most of which were to other accounts in my name held at Natioinwide!
I then spoke to a customer services yesterday and told her that I had written to Nationwide in January asking them to close my account and if the account had been closed when I had asked it to be, none of these charges would have been applied to the account as it would have been closed. I also pointed out that no money had actually been withdrawn from my account and that the whole minus amount was for charges which Nationwide had applied themselves.
I was told that my account wasn't closed because at the end of January there was already a minus balance of £29.10 and that it didn't matter where the negative balance came from, that I was responsible for paying it. I asked why I wasn't informed of this, and why it had taken them two and a half months to contact me (all the while letting dd's bounce back and forth on the account, piling up), and I was told that this was because Nationwide were not responsible for account maintenance and that it was up to the account holder to ensure that their account is up to date.
To a certain degree I understand this, but surely if my request to close my accounts with them was declined for any reason, an immediate phone call should have been forthcoming shouldn't it?
I have now been threatened with legal action if I do not pay up. I have written to them telling them that I am happy to pay the original £29.10 which it would have taken to close my account in January, but am worried I will have to pay the whole lot. Currently I can't afford to do that.
Can anyone shed any light on what I am to expect out of this? Because I don't want a CCJ, which is what they have threatened.
I think you have done the best thing and wrote to them as on the phoen you don't normally get anywhere
did you send the letter in Jan recorded?
