Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I originally took out a mortgage with Infinity Mortgage Ltd in Oct 2007 who then changed to Kensington Mortgage Co Ltd in Nov 2007.
The first direct debit was set up and taken on 1/12/07 but there was an initial outstanding amount that seems to have been missed by either the mortgage company or my mortgage broker for £1094.61.
At the time I received ONE phone call and was asked if I would like this one amount to me put onto the end of the mortgage?
Now as the mortgage has come to the end of its term I am suddenly being bombarded with phone calls (every other day) and letters demanding this amount be paid PLUS interest.
At first I had to establish what this payment was for as there has been no other confirmation or correspondence to confirm and I had to jog my memory back to 2007.
I don't mind paying what I owe but I do not agree to them: (a) adding interest to this amount for the last 3 yrs (b) Never having communicated this to me (other than one phone call in 2007) (c) Filing my details with Experian, etc - giving me a bad credit rating.
I have NEVER defaulted on a payment and have paid regularly every month.
I am about to send a letter so does anyone have any advice of how I should word it and what my rights are?
