    Default Bank taking charges out of my benefits

    Hi all,

    I have been on benefits on and off for a number of years. I have found it very difficult to manage my bank account with Lloydsicon TSB which has incurred charges. These charges have often been taken out of my benefit money.
    I was told on this site that under the SocialAdmin Security Act 1998 they are not allowed to do this.
    I went to the bank and told them this and they agreed and refunded 2 recent charges.
    I took this as the green light to ask for my previous charges back..
    I wrote a letter to the bank asking for past charges back as it was taken out of benefit money (Housing Benefit/Council Tax Benefit & Job Seekers Allowance).
    The bank just replied saying that they do not have to refund the money if the charge is older than 48 hours and in any case it only applies to child benefits.

    Can anyone shed any light on the truth?

    The advice to look at our new subsistence FAQ is very good advice.

    Also, if they are telling you that there are rules about handing money back to you, then you should ask them where the rule is written. If they rely on this kind of stuff then they are obliged to identify the rule they are relying on.

    I would say that you are entitled to recoup your benefits under the 1992 Act. However, that itself doesn't cancel the charges. They would then merely roll up the unpaid charges into a separate debt and pursue you for them.

    My suggestion to you is to forget the benefits money which they have taken from you so far. It is too complicated to pursue them for benefits - and yet still have the charges debt hanging over you.

    I would begin by following our subsistence FAQ and seeing what happens.
    If you follow the instructions we have given to the letter and they ignore you then let us know and we will help you deal with it. I have a little piece of secret weaponry which I am aching to try out.

    Now, as far as getting your charges back, what correspondence have you received from the bank about them?

    By the way, you are probably someone who does of lot of their dealings with the bank on the phone and you don't record your callsicon. DON'T.

    Do everything in writing. Or get a call recorder. truecallicon is best. It may be too expensive for you - but you will never regret it.
