Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have written to Shop Direct diputing a credit account from 2007 - they sent me a letter with proof of debits from my account... these were 4 variable amounts £10, £11, £28.44 and £29... I cancelled this direct debit when I noticed these irregular amounts on my statement, checked my credit file and then wrote to "credit account management" who closed the account when I noted it wasn't mines - I also asked for a refund but that never happened.... the problem is they say I opened this account 27 Nov 2007 (my birthday by the way - not sure if that has anything to do with the supposed account set up date) at an address which I had moved out of that August - they are saying because they have my account details that as far as they are concerned it was not fraudulent and will enforce the Default, but not chase for the outstanding monies... My main concern here is I lived in a shared house with 8 other people - if this debt were genuinely mines i would cop to it, but it isn't - does anyone have any advice on my next course of action?

Thanks for that - just spent 20 mins on the phone with a nice helpful guy and have my crime reference number... thankfully they could help because money was taken which I haven't been reimbursed for... that £64 Shop Direct took could be their undoing in this particular case.

Do everything in writing, in that way it leaves a nice paper-trail and whatever is written cannot be denied.... unlike telephone conversations.

Do you have proof of when you left the address?? If you speak to ShopDirect's Fraud Dept they should be able to sort this for you quite simply by looking at the date that you left your last address, moved into your new one and when the account was opened. Does the account have your correct DOB on it??
If all this information is verifiable then there should be no issue and the Fraud Dept should action the refund and close the account for you. They will also investigate the fraud.
