Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I would like to second both the request, my girlfriend had rossendaleslevy against a car on HP 2 years ago. Not worth it financially, but definitely on principle!
And the praise for the people who plod away at 1.45am to help us!
as far as i am aware as long as you have got the account numbers for rossendales then you should be able to request this information but i am not sure if they can charge for this if it is classed as a Subject access request then there may be a 10 pound charge
when your ct account got passed to rossendales was it just one liability order or two as i have just dealt with rossendales and the robbing b******s had put 140 unlawful fees on my account
if the account is still active then you should be able to request it for free
(sorry just re read ur post)
how long ago is this from?? mr2mr ?
also if she was a single parent at the time then she would of possibly bneen classed as vulnerable this may of affected what they are allowed to charge
about 18-24 months aprox..
i had dealings w them ages ago...
when a Mr Pugh a chinese appearance type, wheel clamped a lease car.
v5 faxed etc , and it took about 24hrs for him to unclamp. only after leasing company threatened them with court etc etc..
i loved that leasing comp lol
If you know what the acoount numbers are you could write a letter for each account along these lines:
"From:
My Name
My Address
To:
Acme Bailiff Co
Bailiff House
Ref: Account No: 123456
Dear Sir
With reference to the above account. Can you please provide me with a breakdown of the charges including Computer Screenshot. This is not a Subject access request under the Data Protection Act S7 1998 so does not incur a fee of £10. I also require the name of the attending Bailiff and the name of the Court he was certificated at. You are obliged to provide this information.
I require this information within 14 days.
Yours faithfully
Ripped off customer"
However if you have multiple accounts or do not know the account number(s) then it is probably best to send for a SAR which should go back 6 years - it costs £10 and hey have up to 40 days to reply, but can produce a lot of info. They could write back and say what they have is in archive etc and can't do it but if it is within the last 6 years then that is their problem as they still have to provide it. If they are then unwilling file a N1 through the county court for non-compliance.
with this being a different address, will we need to provide proof of old address?????
If the account relates to a different address then include that next to the account number on your letter. You should not have to provide any proof but who know. Some of these companies can be very evasive when you ask for details - if I didn't know better I would think thy have something to hide!
Best thing to do is to write and see what comes back.
this place gives has sooo much info.
just wish everyone would hit the bailiffs with the request as once lol
