    Hi. Thank you Pat..
    OK. My problem is that 'cabot'foned me at home last night. I moved house a few months ago I informed them in writting that i didnt have a permanent address but would be maintaing my payments to them, which I have done. They on the fone last night informed me that they had consulted 'experion' for linked addresses and found my current address, they also have somehow obtained my 'x' directory phone number!! This is a gross infringement of my privacy. Firstly, the debt they are refering to is no longer on my credit file, as it was defaulted over 6 six years ago. so why have 'experion' allowed them to look at my file on a debt that no longer exists on my file? And where did they get my 'x' directory fone number from. I feel they have invaded my privacy and data unlawfully. What shall i do..please advise..Also do they have the right to buy the debt in the first place? it was with Capital Oneicon; originally.
    I have always maintained my payments to these snidey sods.
    Any help would be greatly appreciated.

    your phone number will have come from experian....with regards to you keeping up payments this means your data is always readily available through experian...if for instance you make a search through experian it will register and the OC name may have already entered data ,this is data we are not supposed to know about ,but the goverment nor any one else will do anything about it simply because the goverment use there services as well...capitol one will have left a tag with experian that the debt has been sold,the reason may be because at one time or more you have defaulted even though you have come to an arrangement it will always be there ...the only thing you can do at this moment in time is CCA to CABOT and secondley SARicon to CAPITOL ONE 10 pounds for SARicon make sure you register your post 1 pounds for CCA to Cabot again register your post
    then you need also to incorperate within the CCA that you also request the deed of assignment ..this is an important document..and with the SAR you must also ask within the request for the CONTRACT and the Deed of assignment ..
    from here on post all data but remove any identifying names and numbers ok then we can advise...so with regards to the DPA you sadly cannot act on this but you can include within your CCA a letter reminding them that no phone callsicon are acceptable and you request all comunications are by mail only...

    The debt still exists as you are making payments towards it. The 'default marker' has 'fallen off' your credit file as it is more than 6yrs old. The account will, no doubt, still be registered with Experian together with details of the payments made.

    Re the phone number, at sometime in teh past the phone number has been put down on a form and whether you knew it or not you agreed to your data being shared via the CRAs.
    Personally I use a 2nd mobile with a 'disposable' PAYGo SIM, and never give out my landline, that way every now and again I just get a new free SIM with a new number and start again

    If you *must* use a landline number than I also have a couple of SIPGate numbers they just go to voicemail and teh voicemails are emailed to me - works very well.

    i would personally use the voice mail with there number so they email the voice mail back to themselfs hehe out of devilment
